HomeMy WebLinkAbout99-31 - Approving Planned Signing Program ZA-99-06RESOLUTION NO. 99-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNED SIGNING PROGRAM ZA-99-06. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Architectural Designs, authorized agent for ICI Holdings/Stevenson Ranch Partners II, with respect to real property located at 2300 Harbor Boulevard, requesting a planned signing program for Harbor Center in the C1 -S zone; and WHEREAS, the Zoning Administrator approved ZA-99-06 with modifications to the planned signing program on March 18, 1999; and WHEREAS, ZA-99-06 was appealed to the Planning Commission by Council Member Linda Dixon; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on April 26, 1999, at which time the Planning Commission approved ZA-99-06; and WHEREAS, ZA-99-06 was appealed to the City Council by Council Member Heather Somers; and WHEREAS, a duly noticed public hearing was held by the City Council on May 17', 1999; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record, the findings contained in Exhibit "A", and subject to conditions of approval contained in Exhibit "B", the City Council hereby approves Planned Signing Program ZA-99-06 with respect to the property described above. BE IT FURTHER RESOLVED that the City Council hereby finds and determines that adoption of this resolution is expressly predicated upon the activity as described in the staff report for Planned Signing Program ZA-99-06, and upon applicant's compliance with each and all conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this resolution and any recommendation for approval herein contained, shall be deemed null and void. The information presented substantially complies with Costa Mesa Municipal Code Section 13-29(8)(8) in that: (1) The proposed signage, as modified by staff, is consistent with the intent of the City's Sign Ordinance (Chapter VIII). (2) The proposed signs are consistent with each other in design and construction taking into account sign style and shape, materials, letter style, colors, and illuruinalion. Consistency and uniformity will be provided by channel lettering, a nautical thence for the free standing signs, creative lighting techniques, and a mixed media approach to the overall sign design. (3) The proposed signs are compatible with (he buildings and developments they identify - taking into account materials, color, and design motif. The nautical and distinctive type styles proposed , lend themselves well to the modern and curvilinear architectural design elements of the buildings. (4) Approval does not constitute a grant of special privilege or allow substantially greater visibility than what the standard sign provisions would allow. i he proposed 40' high sign is inconsistent with recently -approved free-standing signs for larger commercial properties in this area (Mesa Verde Center 125'1; Connell Nissan 134'1; Mitsubishi 125' heightl; Lincoln 134' height]; Nationwide 125'11. The reduction in height to 35' (Harbor) and 25' (Wilson) will still allow ample visibility of the signs without obstructing, or being obstructed by, other free-standing signs. Furthermore, the 35' height is in closer conformity with Code requirements. Additionally, since the Harbor Boulevard frontage could have eight (8) free-standing signs, the proposal of five such signs on Harbor Boulevard presents less visual clutter. B. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. C. The project is exempt from Chapter XII, Article 3 Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. EXHIBIT "A" Resolution No. 99-31 Page 1 of 1 Z�.o EXHIBIT B CONDITIONS OF APPROVAL The following shall meet all requirements of the following City departments: Ping. 1. The approval of the planned signing program includes the following modifications and restrictions: a. The proposed free-standing signs on Harbor Boulevard shall be reduced in height from 40' and 36' to 35' and 25', and the Wilson Street free-standing sign shall be reduced from 30' to 25' in height. There shall be no more than one (1) free-standing pylon sign with a maximum height of 35 feet, located on Harbor Boulevard. b. No tenant or product/service identity signs shall be installed on the north elevation of the outdoor garden center, Major -3A and Major -4. Also, there shall be no such signs installed on the south elevation of Major -4, Major -3A, and Major -2. The east elevation of S -1A, Majors 2-4, and S-313 shall be limited to 15 sq. ft. maximum, non -illuminated tenant identification sign at the loading entry. c. The south elevation for S -1A may display signage per this planned signing program. d. Any ancillary signs for tenants with over 100,000 sq. ft. lease space shall count toward the total allowable sign area for Harbor Center. e. Any proposed sign allowance adjustments between tenants shall require a letter from the property owner, prior to submittal of sign plans for permits. f. This sign program shall be amended when the corner property (NEC Harbor Boulevard and Wilson Street) is redeveloped. 2. The text of the Planned Signing Program shall be modified to include the signage discussed within the description section of this letter, as well as the change contained with the conditions of approval. The modified text shall be submitted to Planning staff prior to issuance of building permits for the free-standing signs. 3. Planned Signing Program ZA-99-06 herein approved shall be valid until revoked, but shall expire upon discontinuance of the activity authorized hereby for a period of 180 days or more. The conditional use permit may be referred to the Planning Commission for modification or revocation at any time if the conditions of approval have not been complied with, if the use is being operated in violation of applicable laws or ordinances, or if, in the opinion of the development services director or his designee, any of the findings upon which the approval was based are no longer applicable. Street addresses shall be displayed on the freestanding sign or, if there is no freestanding sign, on the fascia or store front adjacent to the main entrance of the building, in a manner visible to the public street. Numerals shall be a minimum 12" in height with not less than %" stroke and shall contrast sharply with the background. Identification of individual units shall be provided adjacent to the unit entrances. Letters or numerals shall be 4" in height with not less than '/4 " stroke and shall contrast sharply with the background. 5. No additional signs shall be added to the free-standing signs, and no other building signs shall be displayed, except for temporary window signs, unless approved through an amendment to this Planned Signing Program. If used, temporary window signs, banners, and balloons shall be so displayed in compliance with the City's Sign Ordinance. 6. All sign plans submitted for sign permits shall be approved by the Harbor Center Management (landlord) prior to submittal to the City. The landlord representative name, title, and date shall be printed on all three sets of sign plans submitted to the City. CODE REQUIREMENTS The following list of federal, state and local laws applicable to the project has been compiled by staff for the applicant's reference. Any reference to "City" pertains to the City of Costa Mesa. Ping. 1. All contractors and subcontractors must have valid business licenses to do business in the city of Costa Mesa. Final inspections and permit finals will not be granted until all such 1 licenses have been obtained. 2. Permits shall be obtained for all signs according to the provisions of the Costa Mesa Sign Ordinance. Bldg. 4. Comply with the requirements of the Uniform Building Code as to design and construction.
