HomeMy WebLinkAbout99-36 - Establishing an incentive for new developments within the City of Costa Mesa335 RESOLUTION NO. 99-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING AN INCENTIVE FOR NEW DEVELOPMENTS WITHIN THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, California Government Code Section 66000 et seq. enables cities to charge fees for transportation facilities; and WHEREAS, on May 17, 1993, the City Council adopted Ordinance 93-11 authorizing the adoption of a traffic impact fee; and WHEREAS, in June, 1993, the City Council adopted Resolutions No. 93-43 and No. 93-53 to establish that the traffic impact fee shall be assessed upon all new development projects which have not received a building permit on or before August 6, 1993; and WHEREAS, in 1994, 1995, 1996, 1997, and 1998, the City Council adopted Resolutions No. 94-59, No. 95-35, No. 96-57, No. 97-51, and No. 98-64 to re- establish the traffic impact fee and conduct an annual review of the fee and a capital improvement plan; and WHEREAS, the reduction of traffic impact fees can serve as an incentive to allow the private market the capability of developing projects which can further the goals and objectives of the Costa Mesa General Plan; and WHEREAS, the partial exemption from the traffic impact fee for projects which results in community development consistent with the goals and objectives of the Costa Mesa General Plan will benefit the public health, safety, and welfare; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa does hereby adopt an incentive for developments within Costa Mesa as follows: 1. The traffic impact fee for all new residential, commercial, and industrial developments within Costa Mesa shall be assessed on an incremental basis as shown below: 2. The adopted incentives for developments in the Newport Boulevard Specific Plan area would continue to be in effect but shall only be applicable for projects which generate more than 100 new average daily trip ends. 3. The incentive for new developments shall be effective until June 30, 2000, or the next annual review of the traffic impact fee program, whichever is earlier.
