HomeMy WebLinkAbout728 - Releasing Segerstrom Water Exploration LeaseRESOLUTION NO. 728 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, RELEASING SEGERSTROM, ET AL., FROM ALL OBLIGATIONS UNDER THE LEASE DATED DECEMBER 4, 1956. WHEREAS, the City of Costa Mesa and Anton H. Segerstrom and Nellie R. Segerstrom, husband and wife, the Estate of Fred A. Segerstrom, deceased, by Anton H. Segerstrom and Harold T. Segerstrom, co-executors, Harold T. Segerstrom and Veronica P. Segerstrom, husband and wife, Henry T. Segerstrom and Yvonne de C. Segerstmm, husband and wife, and Harold T. Segerstrom, Jr. and Jeanette E. Segerstrom, husband and wife, entered into a lease dated December 4, 1956, wherein the hereinafter described real property and certain other real property, was leased by Segerstrom, et al., to the City of Costa Mesa for the purpose of exploration for water, and WHEREAS, said lease provided, and it was the intention of the parties, that said lease was to terminate and all obligations of Segerstroms under said lease were to end upon the sale of any part of said real property, and WHEREAS, the hereinafter described real property is being sold by Lsaid Segerstroms, and it is the desire of the City of Costa Mesa to formally release said Segerstroms from any and all obligations in connection with said lease as to the said real property hereinafter described; NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby resolve as follows: 1. The City Council of the City of Costa Mesa does hereby release the aforementioned Segerstroms from any and all obligations under and pursuant to said lease dated December 4, 1956, and does further release any and all rights and claims to exploration for water on said hereinafter described real property. 2. The real property above referred to is described as follows: A portion of Lot 1 of Tract No. 1083 as shown on a map recorded in Book 35, page 8 of Miscellaneous Maps, records of Orange County, California, a portion of Lot 7 in Block X, a portion of Lot 12 in Block "W", and street adjoining, in Tract No. 766 as shown on a map recorded in Book 22, page 43 of Miscellaneous Maps, Records of said Orange County, together with a portion of Lot 3 of the Williams Tract as shown on a map recorded in Book 30, page 14 of Deeds, records of Los Angeles County, California, described as a whole as follows; Beginning at the intersection of the centerline of Harbor Boulevard as described in a deed recorded June 22, 1959, in Book 4768, page 203 of Official Records with the center line of Huntzinger Avenue as described in a deed recorded June 9, 1904, in Book 103, page 378 of Deeds of said Orange County; thence South 880 50' 55" West along the said centerline of Huntzinger Avenue 1560.00 feet; thence North 10 13' 20" West 1029.36 feet to the Southeasterly line of the 20.00 foot strip of land described in a deed to the City of Santa Ana recorded October 21, 1946 in Book 1460, page 25 of Official Records of said Orange County; thence North 580 18' 40" East along said Southeasterly line 20.94 feet; thence North 880 50' 55" East along a line parallel with the Centerline of Huntzinger Avenue 1541.95 feet to the center line of said Harbor BoAcvard; thence South 10 13' 20" East along the centerline of Harbor Boulevard 1040.00 feet to the point of beginning. 3• This resolution shall become effective upon the date of the recordation of the transfer of title from Segerstroms.
