RESOLUTION NO. 781
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, FINDING, DETERKUTAG AND DECLARING THAT THE
PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF
CERTAIN STREET EASEMENTS AND RIGHTS OF WAY FOR PUBLIC STREET
PURPOSES, AND AUTHORIZING ACQUISITION OF SAID EASEMENTS AND
RIGHTS OF WAY BY CONDEMNATION, AND DIRECTING THE CITY ATTORNEY
TO PROCEED WITH SUCH ACTION.
connections, installation of nater mains and replacement of existing water mains,
install certain pipe, structures and appurtenances for drainage purposes, fire
hydrants and relocation of fire hydrants, remove certain obstructions, together with
appurtenances and appurtenant work in connection therewith, in Santa Ana Avenue and
certain other streets, alleys and easements in said City, as the same is defined and
described in Resolution of Intention No. 761 of said City, adopted on the 18th day
of July, 1960, and
WHEREAS, detailed Plans and Specifications for said work have been
approved by said City and are on file in the Office of the City Clerk, and the City
Engineer has reported and recommended that certain easements and rights of way for
public street purposes in certain lands, in addition to the public streets already
owned by the City, are needed for the completion of said Work in accordance with
said Plans and Specifications, which said additional easements and rights of way
are hereinafter more particularly described, and
WHEREAS, it is in the public interest and necessity to acquire the said
easements and rights of way for public street purposes;
NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby
find, determine, order, declare and resolve as follows:
SECTION 1. That the public interest and necessity require the acquisi-
tion, construction and completion by the City of a public improvement, viz; the
grading, paving, construction of curbs and gutters, concrete cross gutters, house
connection sewers, manholes, Water house connections, installation of water mains
and replacement of existing water mains, installation of certain pipe, structures
l and appurtenances for drainage purposes, fire hydrants and relocation of fire
E` hydrants, removal of certain obstructions, together with appurtenances and appur-
tenant work in connection therewith, in Santa Ana Avenue and certain other streets,
alleys and easements in said City, as described and defined in Resolution of
Intention No. 761.
WHEREAS, the
City of Costa Mesa
is about to grade,
pave, construct curbs

connections, installation of nater mains and replacement of existing water mains,
install certain pipe, structures and appurtenances for drainage purposes, fire
hydrants and relocation of fire hydrants, remove certain obstructions, together with
appurtenances and appurtenant work in connection therewith, in Santa Ana Avenue and
certain other streets, alleys and easements in said City, as the same is defined and
described in Resolution of Intention No. 761 of said City, adopted on the 18th day
of July, 1960, and
WHEREAS, detailed Plans and Specifications for said work have been
approved by said City and are on file in the Office of the City Clerk, and the City
Engineer has reported and recommended that certain easements and rights of way for
public street purposes in certain lands, in addition to the public streets already

WHEREAS, it is in the public interest and necessity to acquire the said
easements and rights of way for public street purposes;
NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby
find, determine, order, declare and resolve as follows:
SECTION 1. That the public interest and necessity require the acquisi-
tion, construction and completion by the City of a public improvement, viz; the
grading, paving, construction of curbs and gutters, concrete cross gutters, house
connection sewers, manholes, Water house connections, installation of water mains
and replacement of existing water mains, installation of certain pipe, structures
l and appurtenances for drainage purposes, fire hydrants and relocation of fire
E` hydrants, removal of certain obstructions, together with appurtenances and appur-
tenant work in connection therewith, in Santa Ana Avenue and certain other streets,
alleys and easements in said City, as described and defined in Resolution of
Intention No. 761.
SECTION 2. That the public interest and necessity require the acqui-
sition for and in connection with said public improvement of the street easements
and rights of way for public street purposes in real property, and as hereinafter
in this Resolution more particularly described.
SECTION 3• That said proposed public improvement 1s planned and located
in a manner which will be most compatible with the greatest public good and the
least private injury.
SECTION 4. That said City proceed, and it is hereby authorized, directed,
and empowered, and Donald Dungan, the City Attorney of said City, is hereby autho-
rized, directed and empowered as follows:
(a) To acquire in the name of the City of Costa Mesa the real
property, interest in real property, and the easements and rights of way in real
property hereinafter expressly described, in and to the said hereinafter des-
cribed real property, or interests in real property, by condemnation, in accord-
ance with the provisions of the Streets and Highways Code, the Government Code,
the Code of Civil Procedure, and the Constitution of the State of California
relating to Eminent Domain.
(b) To prepare and prosecute, in the name of the City of Costa Mesa,
such proceeding or Proceedings in the proper Court having jurisdiction thereof,
as is necessary for such acquisition.
(c) To make application to said Court for an Order fixing the amount
of such security in the way of money deposit, as said Court may direct, and for
an Order permitting said City to take immediate possession and use of said real
property, interests, easements and rights of way in real property, as rights of
way for public street purposes.
(d) To make deposit of such security out of proper funds of said
City, in such amount so fixed and determined, and in such manner as said Court
in which said condemnation proceedings are pending may direct.
SECTION 5• The real property, or interests in real property, or
existing improvements, which the City Attorney of the City of Costa Mesa is
authorized and directed to acquire in the name of the City, is hereinafter des-

"As to all of the following described reel property, or interest in
real property or existing improvements, the interest to be acquired as to each
parcel shall be a perpetual easement and right of way for street purposes."
Said real property, or interests in real property, or existing improve-
ments, to be so acquired by condemnation as the easements and rights of way for public
street purposes, and each parcel thereof, are situated in the City of Costa Mesa,
County of Orange, State of California, and are more particularly described as
follows:
PARCEL I.
That portion of the Southeasterly 132 feet of Lot 211 of
Newport Heights in the City of Costa Mesa, as shown on a
map thereof, recorded in Book 4, Page 83, of Miscellaneous
Maps, Records of Orange County, California, the Northwesterly
line of said parcel of land being parallel to the South-
easterly line of Newport Avenue, described as follows:
The Northeasterly 25 feet of the above described portion of
Lot 211.

That portion of Lot 211 of Newport Heights in the City of
Costa Mesa, as shown on a map thereof, recorded in Book 4,
Page 83, of Miscellaneous Maps, Records of Orange County,
California, beginning at a point in the centerline of 20th
Street, 280 feet Southeasterly from the Westerly corner of
Lot 211, said Westerly corner being the intersection of the
centerline of 20th Street and Newport Avenue; running thence
Northeasterly parallel with the .Northwesterly line of said
Lot 21-1, 330.15 feet to the Northeasterly line of said Lot
211; thence Southeasterly along said Northeasterly line 58
feet; thence Southwesterly parallel with the Northwesterly
line of said Lot 211, 330.15 feet to the centerline of said
20th Street; thence Northwesterly 58 feet to the point of
beginning, described as follows:
A parcel of land lying within Lot 211 and Lot 221 of Newport
Heights as shown on a map thereof, recorded in Book 4, Page
83 of Miscellaneous Maps, Records of Orange County, California,
the boundary of which is described as follows:
Beginning at the most Southerly corner of Lot 221; thence
Southwesterly along the Southeasterly line of Lot 211, 25.00
feet; thence Northwesterly 289.29 feet, parallel with the
Northeasterly line of Lot 211 and distant 25.00 feet South-
westerly therefrom measured at right angles, to the begin-
ning of a tangent curve, concave Southwesterly, having a
radius of 90.00 feet; thence Northwesterly along said curve,
through a central angle of 310 35' ll", a distance of 49.62
feet to the beginning of a tangent reverse curve, concave
Southeasterly, having a radius of 45.00 feet; thence North-
westerly, Northeasterly and Southeasterly along said curve,
through a central angle of 2430 10' 22", a distance of 190.99
feet to the beginning of a tangent reverse curve, concave
Northeasterly, having a radius of 90.00 feet; thence South-
easterly along said curve, through a central angle of 310 35'
ll" a distance of 49.62 feet to the beginning of a tangent
line parallel to and 25.00 feet, measured at right angles,
distant Northeasterly from the Northeasterly line of Lot 211;
thence Southeasterly along said parallel line 249.29 feet to
the beginning of a tangent curve, concave Northerly, having
a radius of 15.00 feet; thence Southeasterly, Easterly, and
Northeasterly along said curve, through a central angle of
900 00' 00", a distance of 23.56 feet to the beginning of a
tangent line parallel to and 25.00 feet, measured at right
angles, distant Northwesterly from the Southeasterly line
of Lot 221; thence Northeasterly along said parallel line
92.00 feet to a point 132.00 feet Northeasterly, measured
at right angles, of the Southwesterly line of Lot 221; thence
Southeasterly 25.00 feet, parallel to the Southwesterly line

PARCEL 3
A portion of the Southeasterly 55 feet of Lots 35 and 36 of
Tract No. 300 in the City of Costa Mesa, as shown on a map
thereof, recorded in Book 14, Pages ll and 12, of Miscellaneous
Maps, Records of Orange County, California, described as
follows:
That portion of Lot 36 lying Easterly of a curve line of 15
foot radius, concave Westerly, being tangent to the South-
westerly line of Santa Isabel Avenue (50 feet wide), and
tangent to the Northwesterly line of Elden Avenue (50 feet
wide).
PARCEL 4.
A portion of the Northwesterly ll7 feet of the Southwesterly
half of Lot 262 of Newport Heights, as shown on a map thereof,
recorded in Book 4, Page 83, of Miscellaneous Maps, Records
of Orange County, California, EXCEPTING the Southwesterly 70
feet thereof; and EXCEPTING the Northeasterly 25 feet thereof,
dedicated to the City of Costa Mesa for street purposes, as
shown in Book 3766, Page 13, Official Records of Orange County,
California, described as follows:
Parcel "A" - The Northwesterly 25.00 feet of the above
described property.
Parcel "B" - A triangular piece of land bounded on the North-
west by the Southeasterly line of Parcel "A" above described,
on the Northeast by the Southwesterly line of Merrill Place
(50 feet wide), and Southerly by a curve line of 15 feet
radius, concave Southerly, and being tangent to the South-
westerly line of Merrill Place and the Southeasterly line
of Parcel "A" above described.
PARCEL 5•
A portion of Lot 15, Tract No. 114, Santa Ana Subdivision No. 1,
as shown on a map thereof, recorded in Book 11, Page 14, of
Miscellaneous Maps, Records of Orange County, California, des-
cribed as follows:
That portion of the above described Lot 15 lying Southerly of a
curve line of 15 foot radius, concave Northerly and tangent to
the Northeasterly line of Virginia Place (50.00 feet wide), and
tangent to the Northwesterly line of Elden Avenue (50 feet wide).
PARCEL 6.
A portion of the Northwesterly 165 feet of Lot 117, Tract No.
300, as shown on a map thereof, recorded in Book 14, Pages
11 and 12, of Miscellaneous Maps, Records of Orange County,
California, described as follows:
A strip of land 50 feet in width lying within Lot 117 and
Lot 118 of Tract No. 300 as shown on a map thereof recorded
in Book 14, Pages 11 and 12 of Miscellaneous Maps, Records
of Orange County, California, the centerline of which is des-
cribed as follows:
Beginning at a point in the Southeasterly line of the North-
westerly one-half of Lot 118, Tract No. 300, distant thereon
139.50 feet, measured at right angles, Northeasterly of the
Southwesterly line of said Lot 118; thence South 500 11' 45"
East 330.00 feet parallel with the Southwesterly line of said
Lot 118, to the Southeasterly line of said Lot 118 and the
beginning of a tangent curve, concave Northeasterly, having a
radius of 425.00 feet; thence Southeasterly along said curve
through a central angle of 100 57' 31", a distance of 81.29
feet to the beginning of a tangent reverse curve, concave South-
westerly, having a radius of 425.00 feet; thence Southeasterly

Beginning at a point on the East line of 20th Street, 150 feet
Southeasterly from the Southeasterly line of Newport Avenue,
running thence Northeasterly parallel to Newport Avenue, 300.15
feet to the Northeasterly line of Lot 211 of Newport Heights;
thence Southeasterly along the Northeasterly line of Lot 211,
100 feet; thence Southwesterly parallel to the centerline of
Newport Avenue, 300.15 feet to the Southwesterly line of Lot 211;
thence Northwesterly along said lot line, 100 feet to the point
of beginning, described as follows:
A parcel of land lying within Lot 211 and Lot 221 of Newport
Heights as shown on a map thereof recorded in Book 4, Page 83,

Beginning at a point being the intersection of the Northwesterly
line of Elden Avenue (50.00 feet wide) with the Southwesterly
line of Monte Vista Avenue (60.00 feet wide); thence Southwesterly

2.00 feet; thence Northerly along a line to its intersection
with the Southwesterly line of Monte Vista Avenue at a point

PARCEL 9.
The portion of Lot 109, Tract No. 300, as shown on a map
thereof recorded in Book 14, Page ll, Miscellaneous Maps,
Records of Orange County, California, described as follows:
Beginning at the intersection of the Southwesterly line of
Wilson Street (60.00 feet wide) with the Northwesterly line
of Orange Avenue (55.00 feet wide); thence Southwesterly
along said Northwesterly line a distance of 2.00 feet; thence
Northerly along a line to its intersection with the Southwes-
terly line of Wilson Street distant Northwesterly thereon 2.00
feet from the point of beginning, thence Southeasterly along
said Southwesterly line to the point of beginning.
PARCEL 10.
That portion of Lot 55, Tract No. 114, as shown on a map
thereof recorded in Book 11, Page 14, of Miscellaneous Maps,
Records of Orange County, California, described as follows:
Beginning at the intersection of the Northwesterly line of
Orange Avenue (60.00 feet wide) with the Northeasterly line
of Albert Place (50.00 feet wide); thence Northwesterly along
said Northeasterly line a distance of 2.00 feet; thence
Easterly along a line to its intersection with the North-
westerly line of Orange Avenue distant Northeasterly thereon
2.00 feet from the point of beginning; thence Southwesterly along
said Northwesterly line to thepoint of beginning.
PARCEL 11.
A portion of Lot 16, Tract No. 269, as shown on a map thereof
recorded in Book 18, Page 33, Miscellaneous Maps, Records of
Orange County, California, described as follows:
Beginning at a point being the intersection of the South-
westerly line of Cecil Place (50.00 feet wide) and the North-
westerly line of Orange Avenue (60.00 feet wide); thence
Southwesterly a distance of 2.00 feet along said line of
Orange Avenue; thence Northerly along a line to its intersec-
tion with the Southwesterly line of Cecil Place at a point
thereon 2.00 feet Northwesterly from the point of beginning;
thence Southeasterly along said line of Cecil Place to the
point of beginning.
SECTION 6. That the City Clerk shall verify the adoption of this
Resolution.

that said Resolution was then passed and adopted as a whole by the following
