RESOLUTION NO. 98-48
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, DENYING PLANNING
APPLICATION PA -98-02.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by BMA Consulting, authorized agent for
Neron Limited, with respect to real property located at 524-A West 19th Street,
requesting a conditional use permit to allow automobile heating, electrical, and air
conditioning repair in a Downtown Redevelopment Project Area, located within 200
feet of a residential zone, and for retail sales of automobiles at the same location in
a C2 zone; and
WHEREAS, a duly noticed public hearing was held by the Planning Commission
on February 9, 1998; and
WHEREAS, the applicant appealed the Planning Commission's action to the City
Council; and
WHEREAS, the City Council held a duly noticed public hearing on March 16,
1998, at which the request was denied by adoption of Resolution No. 98-19; and
WHEREAS, a rehearing was requested and the City Council held a duly noticed
public hearing on May 4, 1998;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record
and findings contained in Exhibit "A"; the City Council hereby denies Planning
Application PA -98-02 with respect to the property described above.
PASSED AND ADOPTED this 1st day of June, 1998.

EXHIBIT "A"
FINDINGS
A. The information presented does not substantially comply with Costa Mesa
Municipal Code section 13-29(g)(2) in that the proposed automotive repair use
and retail sales of automobiles are not substantially compatible with
developments in the same general area. Specifically, the building is a retail
strip center and is not designed for automotive repair. Furthermore,
automobile repair activities will generate adverse impacts for residentially -
zoned and developed property to the north. Granting the conditional use
permit will be detrimental to the health, safety and general welfare of other
properties, residents, and businesses within the immediate vicinity.
B. The proposed uses are not consistent with the guidelines of the
Redevelopment Plan which specifically discourages such uses.
C. An initial study was prepared, pursuant to the California Environmental Quality
Act. According to the initial study and negative declaration, which reflect the
independent judgment of the City of Costa Mesa, the proposed project could
not have a significant effect on the environment.
D. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
E. The evidence presented in the record as a whole indicates that the project
will not individually or cumulatively have an adverse effect on wildlife
resources or habitat.
