HomeMy WebLinkAbout98-71 - Approving Planned Signing Program ZA-98-10432 RESOLUTION NO. 98-71 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNED SIGNING PROGRAM ZA-98-10. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by RFA, Inc., authorized agent for Chevron Products, with respect to real property located at 3190 Harbor Boulevard, requesting a planned signing program to allow a 65 -foot high, 163 -square -foot freestanding, freeway -oriented sign on a 19,950 -square -foot Chevron service station site in a C1 zone; and WHEREAS, after notice of public hearing to consider the request, the Zoning Administrator denied the planned signing program on May 21, 1998; and WHEREAS, the item was appealed to the Planning Commission, and a duly noticed public hearing was held by the Commission on June 22, 1998, at which time the Planning Commission approved the application; and WHEREAS, a request was received for Council review of the Planning Commission's decision, and a duly noticed public hearing was held by the City Council on July 20, 1998; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and findings contained in Exhibit "A"; and subject to conditions of approval contained in Exhibit "B", the City Council of the City of Costa Mesa hereby approves Planned Signing Program ZA-98-10 with respect to the property described above. BE IT FURTHER RESOLVED that the City Council does hereby find and determine that adoption of this resolution is expressly predicated upon the activity described in the staff report for Planned Signing Program ZA-98-10, and upon applicant's compliance with each and all conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this resolution and any recommendation for approval herein contained, shall be deemed null and void. The proposed sign is consistent with the intent of the sign ordinance and the General Plan. b. Approval would not constitute a grant of special privilege or allow substantially greater visibility than the standard ordinance provisions allow because other freeway -oriented signs already exist under similar conditions. C. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. Exhibit "A" Resolution No. 98-71 Page 1 of 1 1 EXHIBIT "B" CONDITIONS OF APPROVAL Ping. 1. Approved sign area may not exceed 163 sq. ft. in area, or 65 feet in height. 2. Conditions of approval of PA -98-04 are still valid where applicable. 3. The face of the sign facing away from the freeway shall be either blank, and/or non -illuminated. CODE REQUIREMENTS The following list of federal, state, and local laws applicable to the project has been compiled by Staff for the applicant's reference. Any reference to "City" pertains to the City of Costa Mesa. Ping. 1. The proposes sign shall be installed in a landscaped planter area equal to twice the area of the proposed sign. 2. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final inspections will not be granted until such licenses have been obtained. 3. Approval of the zoning application is valid for one year and will expire at the end of that period unless building permits are obtained, or the applicant applies for and is granted an extension of time. Bldg. 4. Submit a soil report and structural calculations that address seismic and wind load. Soil report should discuss potential for liquefaction. 5.
