HomeMy WebLinkAbout820 - Opposing AB 127 - Brown Act RestrictionsRESOLUTION NO. 820 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA OPPOSING THE PROPOSED EXTENSION OF THE BROWN ACT BY AD 127 AS AN UNNECESSARY, UNWARRANTED AND CRIPPLING RESTRICTION OF THE FUNCTIONING OF LOCAL LEGISLATIVE BODIES IN THE BEST IN- TEREST OF THEIR MUNICIPALITIES. WHEREAS, the provisions of the proposed AB 127 would require open j meetings of local legislative bodies for the discussion of pending, pro- posed or anticipated litigation with counsel, and thereby place a municipality at a serious disadvantage in dealing with an adversary of the people; and WHEREAS, the proposed AB 127 would prevent free discussion of muni- cipal affairs by and between members of local legislative bodies, and could cripple research and exploratory study, and the consideration of hypothetical cases; end WHEREAS, the provisions of the proposed AS 127 would act as a barrier to free, open, and unguarded interchange of opinion between councilmen in informal discussion of municipal affairs; and tt■■ WHEREAS, the proposed AB 127 contains, by implication, an unwarranted J and derogatory reflection on the integrity of local legislative bodies in every city in the State; and WHEREAS, the enactment of the proposed AS 127 would reverse recent de- cisions of the California Appellate Courts, and would impede the functioning of local legislative bodies in the performance of their duties in the best interest of the public; N0W, THEREFORE, BE IT RESOLVED, by the City Council of the City of Costa Mesa, that the protection of the public interest, and the preservation of the constructive functioning of local government in California, demand the defeat of the proposed AB 127; and BE IT FURTHER RESOLVED, that the City Clerk of the City of Costa Mesa be hereby directed to forward certified copies of this Resolution to Assembly- ■ ! man Richard T.
