A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
OPPOSING SENATE BILL 208 AS DEPRIVING PUBLIC OFFICES AND
EMPLOYEES OF DUE AND NECESSARY PROMPT NOTICE OF THE FILING
OF CLAIMS. 11
WHEREAS, Senate Bill 208 would repeal all of the statutory requirements J
for the filing of a claim, when suit is brought against a public employee or
public officer; and
WHEREAS, Senate Bill 208 would deprive public employees and municipalities
of the prompt notice of such claims which is necessary for the efficient protec-
tion of the public health and safety; and
WHEREAS, Senate Bill 208 is based on an assumption that private employees
and public employees perform the same kinds of functions, and fails to take
into consideration the fact that city engineers, building inspectors, and
many other classes of municipal employees have no counterparts in private
employment; and
WHEREAS, Senate Bill 208 would not only place public employees at an unfair
disadvantage, but also would increase the cost to municipalities of insuring
employee liability; and
WHEREAS, it is vitally necessary for the protection of the public health
and safety that proper and prompt notice be required for the filing of any claim
against a public employee or a public officer;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Costa
Mesa, that the repeal of Sections 800 through 803 of the Government Code, as
proposed in Senate Bill 208 would dangerously impair the efficiency of
municipal government; and
HE IT FURTHER RESOLVED, that this City Council hereby unanimously expresses
its opposition to Senate Bill 208 and urges its representatives in the State
Legislature to make every effort to prevent its passage.
