HomeMy WebLinkAbout99-58 - Approving Master Plan Amendment PA -99-3621 RESOLUTION NO. 99-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING MASTER PLAN AMENDMENT PA -99-36. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by C. J. Segerstrom and Sons with respect to real property located at 3333 Bristol Street and 3333 Bear Street, requesting approval to amend Condition of Approval No. 1 of Master Plan PA -98-90 in the PDC zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on August 23, 1999, at which time the Planning Commission recommended approval of the request; and WHEREAS, a duly noticed public hearing was held by the City Council on September 7, 1999; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", and subject to conditions contained in Exhibit "B", the City Council hereby approves Master Plan Amendment PA -99-36 with respect to the property described above. BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and determine that adoption of this resolution is expressly predicated upon the activity as described in the staff report for Master Plan Amendment PA -99-36, and upon applicant's compliance with each and all of the conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this resolution, and any recommendation for approval herein contained, shall be deemed null and void. PA -99-36 A. The information presented substantially complies with Costa Mesa Municipal Code Section 13-29 (9)(5) in that the master plan meets the broader goals of the General Plan, the North Costa Mesa Specific Plan, and the Zoning Code by exhibiting excellence in design, site planning, integration of uses and structures, and protection of the Additionally, the nighttime work, integrity of as proposed, will neighboring development. not exceed the maximum noise levels allowed by Code_ B. PA -99-36 Ping. 1. All nighttime construction shall comply with the City's noise ordinance or, if the construction does not comply with the noise ordinance, the work shall cease immediately, unless a variance from the requirements of the noise ordinance is obtained. 2. The applicant shall send written notice to all residents within 300 feet of the project, confirming the nighttime construction, the proposed measures to mitigate construction noise, and containing a phone number where concerned citizens can contact South Coast Plaza security 24 hours a day, seven days a week to report noise complaints. Proof of the notice shall be submitted to Planning staff prior to commencement of nighttime work on the bridge. 3. Applicant shall comply with the noise mitigation measures, education, and complaints and enforcement procedures delineated in the memo from Behrens and Associates, received by City on August 9, 1999. 4. Applicant is reminded that all conditions of approval 2 through 16, code requirements, and special district requirements of Master Plan Amendment PA -98-90 still apply. 5. Nighttime construction shall be allowed for 14 days, and any additional nighttime construction shall be referred to the City Council for approval. CODE REQUIREMENTS 1 The following list of federal, state and local laws applicable to the project has been compiled by staff for the applicant's reference. Any reference to "City" pertains to the City of Costa Mesa. Trans 1. A traffic control plan and lane closure permit is required for any work on the section of the bridge over Bear Street that necessitates closing traffic lanes beyond the present northbound and southbound curb lane closures previously approved.
