HomeMy WebLinkAbout94-57 - Denying PA -94-11 (RA -94-04) Stag Bar118 RESOLUTION NO. 94-57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DENYING PLANNING ACTION PA -94-11, REDEVELOPMENT ACTION RA -94-04. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by William Murdock, authorized agent for Pope Family Trust, with respect to real property located at 145 East 19th Street, requesting Conditional Use Permits to legalize expansion of the Stag Bar and to deviate from shared parking requirements in the Cl zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on March 28, 1994, and a hearing was held by the Redevelopment Agency on May 11, 1994; and WHEREAS, an interested part filed an appeal of said Planning Commission and Redevelopment Agency decisions on May 18, 1994; and WHEREAS, the City Council held duly noticed public hearings on June 6, 1994, and June 20, 1994; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", the City Council hereby DENIES Planning Action PA -94-11, Redevelopment Action RA -94-04, with respect to the property described above. PASSED AND ADOPTED this 20th day of June, 1994. The information presented does not substantially comply with Costa Mesa Municipal Code Section 13-347 in that the proposed use is not substantially compatible with developments in the same general area; granting the Conditional Use Permit will be detrimental to the health, safety and general welfare of the public or other properties or improvements within the immedi- ate vicinity; specifically, the proposed expansion will have negative impacts on the public safety and on the quality of life of the residents who live both to the south and east of the project site. Additionally, pertaining to the deviation from the shared parking requirements, the business will not operate at hours differing from the remaining uses on the site. B. The project has been reviewed for compliance with the Califor- nia Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA because the project has no possibility of causing a significant effect on the environment. C. The project, as conditioned, is consistent with Article 22h, Transportation Systems Management, of the Costa Mesa Munici- pal Code in that no intersection to which the project con- tributes measurable traffic shall operate at less than the Standard Level of Service as a result of project implementa- tion.
