HomeMy WebLinkAbout94-58 - Approving ZE-80-43A2 Ross Stores120 RESOLUTION NO. 94-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING ZONE EXCEPTION PERMIT ZE-80-43A2. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Bill Moore and Associates, authorized agent for DMP Properties, with respect to real property located at 277 - 289 East 17th Street, requesting an amendment to a Planned Signing Program in the C1 -S zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on May 23, 1994; and WHEREAS, an interested party filed an appeal of said Planning Commission decision on May 31, 1994; and WHEREAS, the City Council held a duly noticed public hearing on June 20, 1994; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", and subject to conditions contained in Exhibit "B", the City Council hereby APPROVES Zone Exception Permit ZE-80-43A2 with respect to the property described above. BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon operation of the business or activity in the manner described in the staff report for Zone Exception Permit ZE-80-43A2, and upon applicant's compliance with each and all of the conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this Resolution, and any approvals herein contained, shall be deemed null and void. The information presented substantially complies with Costa Mesa Municipal Code Section 5-122 in that the signing included in the Planned Signing Program, as modified by Staff, is consistent with the intent of the Sign Code and the General Plan; signs included in the Planned Signing Program have unifying design criteria and approval does not allow substan- tially greater visibility than what Code would allow. B. The project has been reviewed for compliance with the Califor- nia Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. C. The project is exempt from Article 22-1/2 , Transportation Systems Management, of the Costa Mesa Municipal Code. Exhibit "A" Resolution No. 94-58 Page 1 of 1 121 122 EXHIBIT "B" CONDITIONS OF APPROVAL APDL. ZE-80-43A2 Ping 1. The following signing shall be permitted: a. Ross Dress for Less: i. One 25' high, 120 sq.ft. ground sign to be placed at the furthest possible point away from the existing Carl's Jr. sign along the East 17th Street frontage. Maximum letter height: 28". ii. One wall sign on the East 17th Street frontage. Maximum letter height: 48" for the word "Ross" and 36" for the words "Dress for Less". iii. Wall signage shall be allowed on Santa Ana Avenue frontage at a maximum of 14" letter height with number of items and area as defined by Sign Code. b. Carl's Jr: i. One 30 sq.ft. cabinet sign facing East 17th Street and one 30 sq.ft. cabinet sign facing Santa Ana Avenue. 20" maximum letter height permitted for both signs. ii. One 39 sq.ft., ground sign, with a maximum height of 101. Maximum letter height of 28". C. Other tenants (excluding photo kiosk): i. Inclusion on one of the six (three per side) 10" by 6' panels to be placed under the 39 sq.ft. portion of the Carl's Jr. ground sign. Name is not to appear more than once per side. ii. One cabinet sign, 28" in height, not to exceed 14' or 80% of the width of the suite in length. The cabinets are to be attached to the building at a uniform height. 14" maximum letter height for tenants facing Santa Ana Avenue and 28" maximum letter height for tenants facing East 17th Street permitted. d. Photo kiosk: To be incorporated into the facia of the building. Maximum letter height of 14" towards Santa Ana Avenue and 28" towards East 17th Street. Maximum sign area of 7.5 sq.ft. for each of the four sides (blocking around individual letters). 2. Street addresses shall be displayed on the ground sign (if permitted) or on the fascia or store front adjacent to the main entrance of the building, in a manner visible to the public street. Numerals shall be 12" in height with not less than 3/411 stroke and shall contrast sharply with the background. Identification of individual units shall be provided adjacent to the unit entrances. Letters or numerals shall be 4" in height with not less than 1/4" stroke and shall contrast sharply with the background. Exhibit "B" Resolution No. 94-58 Page 1 of 2 1 The following list of Federal, State, and local laws applicable to the project has been compiled by Staff for the applicant's . reference. Ping 1. Permits shall be obtained for the illegal change of copies for Jenny Craig, the photo kiosk, the check cashing and art center tenants within 30 days of Planning Commission action. 2. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final occupancy and utility releases will not be granted, and final inspections will not be granted until all such licenses have been obtained. 3. Permits shall be obtained for all signs, including banners and other special event signing, according to the provisions of the Costa Mesa Sign Ordinance. Bldg 4.
