HomeMy WebLinkAbout94-78 - Approving Tentative Parcel Map S-94-1439f;7 RESOLUTION NO. 94-78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP 5-94-143. THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: WHEREAS, an application was filed by David Ball authorized agent for A&R Parcel Four and R&A Parcel Five with respect to real property located in the 900 block (odd numbers only) of South Coast Drive, requesting a Tentative Parcel Map to divide an approximate 28 -acre site into 13 parcels located in the PDC zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on July 25, 1994, and by the City Council on August 15, 1994; NOW BE IT RESOLVED that, based on the evidence in the record and the findings contained in Exhibit "A", and subject to the conditions contained in Exhibit "B", the City Council hereby approves Tentative Parcel Map 5-94-143 with respect to the property described above. The proposed parcel map satisfies standards set forth in the Costa Mesa Municipal Code Section 13-443 in that: 1. The creation of the subdivision and related improvements is consistent with the General Plan and PDC zone. 2. The proposed use of the subdivision is consistent with the General Plan. 3. The subject property is physically suitable to accommo- date the subdivision. 4. The subdivision will not interfere with public utility rights-of-way and/or easements. B. An initial study was prepared which was tiered to Program Final Environmental Impact Report #1044, pursuant to the California Environmental Quality Act. Although the proposed project could have a significant effect on the environment, according to the Initial Study and Negative Declaration, which reflect the independent judgement of the City of Costa Mesa, there will not be a significant effect on the environment because mitigation measures have been added to the project. C. The evidence presented in the record as a whole indicates that the project will not individually or cumulatively have an adverse effect on wildlife resources or habitat. 1 Exhibit "A" "Resolution No. 94-78 Page 1 of 1 1 EXHIBIT "B" CODE REQUIREMENTS APPL. 8-94-141 The following list of Federal, State, and local laws applicable to the project has been compiled by Staff for the applicant's reference. Engr. 1. Per requirements of Real Property, City of Costa Mesa, Engineering Division, submit legal descrip- tion for a new area of dedication, plat of new dedication area, both prepared by a Civil Engineer, and Title Report Update of Subject Property. 2. Submit nine copies and one duplicate mylar of recorded map or signed plan to Engineering Divi- sion, City of Costa Mesa, prior to occupancy. 3. Prior to recordation of a final tract/parcel map, the surveyor/ engineer preparing the map shall tie the boundary of the map into the Horizontal Control System established by the County Surveyor in a manner described in Sections 7-0-330 and 7-0-337 of the Orange County Subdivision Code and Orange County Subdivision Manual, Subarticle 18. 4. Prior to recordation of a final tract/parcel map, the surveyor/engineer preparing the map shall submit to the County Surveyor a digital -graphics file of said map in a manner described in Sections 7-9-330 and 7-9-337 of the Orange County Subdivi- sion Code and Orange County Subdivision Manual, Subarticle 18.
