HomeMy WebLinkAbout92-106 - Screening Criteria for Funds -Proposition 116 Clean Air and Transportation Act279 RESOLUTION NO. 92-106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CERTIFYING APPLICATION SCREENING CRITERIA FOR FUNDS AVAILABLE THROUGH THE PROPOSITION 116 CLEAN AIR AND TRANSPORTATION IMPROVEMENT ACT (CATIA) OF 1990. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City of Costa Mesa desires to apply for funds available through the Proposition 116 Clean Air and Transportation Improvement Act (CATIA) of 1990; and WHEREAS, the application process for said funds necessitates a resolution certifying compliance with the application screening criteria; and WHEREAS, the Proposition 116 Bicycle Program Screening Criteria is attached as Exhibit "A" and made part of this resolution; NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby resolve that Costa Mesa satisfies the screening criteria to be eligible for CATIA bicycle program funds. City Clerk and ex -officio Clerk of City Council of the City of Costa M X280 EXHIBIT "A" Proposition 116 Bicycle Program Project Screening Criteria 1. Statutory Eligibility - City of Costa Mesa application meets the statutory requirement to be eligible for CATIA funding, pursuant to Section 99650 of the Clean Air and Transportation Improvement Act of 1990. 2. Policy Board Approval - City of Costa Mesa's policy board/body approved the project and the project fund application. 3. Financial/Management Capacity - City of Costa Mesa has the resources and financial capacity to construct, operate, and maintain the project, and will operate and maintain the project until at least 2010. 4. Timely Use of Funds - City of Costa Mesa will be able to expend the state bond proceeds approved for Costa Mesa for reimbursements of eligible capital costs within 24 months of the close of bond sale, and reimbursements of eligible right- of-way acquisition costs within six months of the close of the bond sale. 5. Environmental Documentation - City of Costa Mesa has completed, or will complete prior to allocation of state funds, the required environmental documentation, pursuant to the California Environmental Quality Act (CEQA). 6. Design Standards - The bikeway projects will be designed in conformity with the standards set forth in Chapter 1000 of the Highway Design manual, "Bikeway Planning and Design." 7. No other capital funds previously programmed, planned, or approved for bicycle projects will be used for other purposes. 8. New development fees, taxes or exactions, or permit fees have not and will not be included in the operating budgets for this project. 9. No other state funding sources will be used to complete this project if costs exceed those identified in the approved application. 10. The City of Costa Mesa has the financial and institutional ability to accept the legal liabilities associated with this project. KAT I A AES I Resolution No. 92-106
