HomeMy WebLinkAbout92-45 - Waiving Bid Process for Completion of Metro Fire StationRESOLUTION NO. 92-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE WAIVING THE BID PROCESS FOR PUBLIC WORKS AGREE- MENTS FOR COMPLETION OF THE METRO FIRE STATION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, on April 1, 1991, the City, as authorized by the City Coun- cil, entered into a contract ("the Agreement") with The Edwards Development Corporation, 'doing business as The Edwards Group ("Contractor") for con- struction of the Metro Fire Station located at 3350 Sakioka Drive ("the Project"); and WHEREAS, Contractor has defaulted in its performance of the Project and the Agreement has been terminated in accordance with the terms thereof; and WHEREAS, prompt completion of the Project is necessary to safeguard life, health, and property; and WHEREAS, the City desires to achieve completion of the Project at the earliest practicable date; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: 1. It is necessary to complete the work remaining on the Project on an emergency basis in order to assure the safety of residents, tenants, and visitors in the area to be served by the Metro Fire Station. 2. Advertising for new bids and otherwise complying with laws or regulations requiring competitive bidding for completion of the Project would further delay completion of the Metro Fire Station. 3. The public interest and necessity demand the immediate expenditure of public money to assure prompt completion of the Project, including but not limited to funds previously allocated for performance of the Agreement, to safeguard life, health, and property. 4. Such contracts as are necessary for the prompt completion of the Project may be entered into without advertising for or obtaining competi- tive bids, notwithstanding any laws or regulations requiring competitive bidding to the contrary.
