HomeMy WebLinkAbout92-47 - Intention to Levy Assessments, Landscaping Assessment District No. 1RESOLUTION NO. 92-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS DURING FISCAL YEAR 1992-1993 WITHIN CITY OF COSTA MESA LAND- SCAPING ASSESSMENT DISTRICT NUMBER 1. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, on April 20, 1992, this Council adopted Resolution No. 92-40, initiating proceedings for renewal of City of Costa Mesa Landscaping Assessment District Number 1 and ordering the Project Manager to prepare a report with respect to said district pursuant to Section 22565 through and including Section 22574 of the California Streets and Highways Code; and WHEREAS, said report was prepared and filed with the City Council; and WHEREAS, the City Council approved said report as filed; NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: 1. The City Council hereby declares its intention to levy and collect assessments pursuant to Part 2, Division 15, of the Streets and Highways Code of the State of California during fiscal year 1992-1993 within City of Costa Mesa Landscaping Assessment District Number 1, located generally south of Sunflower Avenue and east of Smalley Road and more particularly described in Exhibit "A", attached hereto and incorporated herein by reference. 2. A general description of improvements relevant to said district is as follows: The maintenance and possible future replacement of landscaping and any facilities which are appurtenant thereto, or which are necessary or convenient for the maintenance or possible future replacement thereof, including removal of debris, and maintenance and repair of water irrigation or drainage facilities on lettered Lots B and C of Tract 9901, and lettered Lots A and B of Tract 12011. No substantial changes are proposed to be made in existing improvements. 3. Reference is hereby made to the report of the Project Manager relating to the said district. Said report is on file with the City Clerk of the City of Costa Mesa and contains a full, detailed description of the improvements, the boundaries of the proposed assessment district, and the proposed assessments upon assessable lots and parcels of land within City of Costa Mesa Landscaping Assessment District Number 1. Said report is attached hereto as Exhibit "B" and incorporated herein by reference. 4. The City Council hereby fixes 6:30 p.m., or as soon as possible thereafter, on June 1, 1992, in the Costa Mesa City Council Chambers, 77 Fair Drive, Costa Mesa, California, as the time and place for a hearing before this Council on the levy and collection of the proposed assessments within City of Costa Mesa Landscaping Assessment District Number 1, and hereby gives notice of said hearing. 5. The City Clerk shall certify to the adoption of this Resolution and shall cause a true and correct copy of this Resolution to be published at least 10 days prior to said hearing in the manner required by Section 6061 of the Government Code, and to be posted on the bulletin board in the lobby of the Costa Mesa City Hall. This Specific Plan set as a development standard for the area in question that a "private mandatory homeowner's association or landscape assessment district must be established", and that "such an association or assessment district shall be responsible for the maintenance of the required setbacks along Smalley Road and Sunflower Avenue". Tract 12011 was annexed to this Landscaping Assessment District by the City Council through the adoption of Resolution No. 84-82. A Condition of Approval for Tract 12011 was that a private mandatory homeowners' associa- tion or landscape assessment district be formed to establish and to main- tain landscaped setbacks along Smalley Road similar to that in Landscape Assessment District No. 1. SECTION III nRgCRTPTTnN A. General A diagram of the City of Costa Mesa Landscaping Assessment District No. 1 is included herein. The District is located south of Sunflower Ave- nue and east of Smalley Road. The lands within the District are designated as Tracts 9901 and 12011 which have received approval of the Planning Com- mission and the City Council of the City of Costa Mesa. B. Plans and Specifications Plans and specifications for the improvement of this project are on file in the office of the Community Services Department. The plans include the installation of landscaping and an irrigation system as required by the City's conditions for development. The plans and specifications are hereby incorporated into this report by reference. C. Estimate of the Costs of the Improvements No improvement costs will be assessed against the lands within the District. All such improvements were contributed to the District as a condition of development for Tracts 9901 and 12011. Maintenance costs are discussed in Section IV of this report. D. Assessment Diagram A diagram of the Assessment District entitled "City of Costa Mesa Landscaping Assessment District No. 1" in the City of Costa Mesa, County of Orange, State of California, is included herein. 90 E. Lines and Dimensions The boundaries of the District are described as being Lots 1 through 50 of Tract 9901, City of Costa Mesa, County of Orange, as per map recorded in Book 417, Pages 49 and 50 of Miscellaneous Maps in the office of the County Recorder of Orange County, State of California; and Iots 1 through 50 of Tract 12011, City of Costa Mesa, County of Orange, as per map filed in Book 520, Page 50 of Miscellaneous Maps in the office of the County Recorder of Orange County, State of California. 8 SECTION IV ASSESSMENT A. General The assessment costs contained herein are for maintenance only. The costs of improvements, as previously stated, have been contributed by the developers of Tract 9901 and 12011 with no costs of such improvements assessed against the lands. B. Basis for Cost Data Maintenance cost estimates are based on previous years' experience, with adjustments to anticipate future conditions. Maintenance costs for Fiscal Year 1991-92 are based on actual costs from July 1, 1991, through March 31, 1992, and estimated costs from April 1, 1992, through June 30, 1992. Adjustments for actual fourth quarter costs will be included in the 1992-93 report. C. SECTION V ZONES OF BENEFIT All parcels in Lots B and C of Tract 9901, and in Lots A and B of Tract 12011, will benefit equally from the maintenance of the landscaped areas shown in Appendix B. Therefore, no zones of benefit have been established, and all parcels will share equally in the assessment for maintenance.
