HomeMy WebLinkAbout92-51 - Establishing Fee for Off -Site Hazardous Waste FacilitiesRESOLUTION NO. 92-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING A PLANNING DIVISION PROCESSING FEE FOR PROPOSED OFF-SITE HAZARDOUS WASTE FACILITIES. WHEREAS, Health and Safety Code Sections 25199.7(a) and 25199.7(d), arra Government Code Section 66014(a), enables cities to adopt fees for planning -related services in conjunction with processing applications for proposed off-site hazardous waste facilities, provided that the fees do not exceed the reasonable cost of providing these services; and WHEREAS, the City has not processed such an application to date, and the amount of staff time required to process such an application is antici- pated to greatly vary frau project to project; therefore, a fee based on time and materials is most equitable; and WHEREAS, pursuant to Government Code Section 66016(a), notice was mailed to all interested parties on record fourteen (14) days prior to this public hearing, and notice of this public hearing was given in a manner consistent with Government Code Section 6062a; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa that the attached Planning Division Fee Schedule shall be instituted upon the effective date of Ordinance No. 92-11, and shall be effective no sooner than 60 days after the adoption of this resolution pursuant to Government Code Section 66017(a).
