Phinney, City Clerk Post Office Box 1200 Costa Mesa, CA 92628-1200 Recorded November 5, 1992 Document No. 92-754753 RESOLUTION NO. 92-52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, SUMMARILY VACATING PUBLIC RIGHTS-OF-WAY AT THE NORTHWEST CORNER OF 18TH STREET AND NEWPORT BOULEVARD. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY FIND AS FOLLOWS: WHEREAS, the City Council of the City of Costa Mesa did, on the 20th day of April, 1992, adopt Resolution No. 92-38 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF PUBLIC RIGHT-OF-WAY AT THE NORTHWEST CORNER OF 18TH STREET AND NEWPORT BOULEVARD"; and WHEREAS, pursuant to said Resolution of Intention, the time and place for hearing all persons interested in objecting to the proposed vacation was set for Monday, the 18th day of May, 1992, at the hour of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California; and WHEREAS, on said date of hearing, the proposed vacation came on regu- larly to be heard; all persons appearing on the proposed vacation were heard; and said hearing was closed on the 18th day of May, 1992; and WHEREAS, pursuant to Chapter 4 of Part 3 of Division 9 of the Cali- fornia Streets and Highways Code, the City Council may summarily vacate an excess right-of-way of a street or highway not required for street or high- way purposes; and WHEREAS, the City Council finds that the rights-of-way described on the attached right-of-way map, a copy of which will be permanently main tained by the City Clerk, are excess and are not required for street or highway purposes; and WHEREAS, the Costa Mesa Planning Commission considered and found that vacation of the described rights-of-way are consistent with the City's General Plan; and WHEREAS, the City Council finds that vacation of the described rights- of-way are consistent with the City's General Plan; and WHEREAS, the City Council finds that the described rights-of-way are not useful as nonmotorized transportation facilities as defined in Section 156 of the California Streets and Highways Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOWS: 1. The rights-of-way described on the attached right-of-way map are excess and not required for streets and highways purposes. 2. It is hereby ordered that the described rights-of-way be, and the same are hereby vacated, except as provided herein. 3. Reserved from the vacation of rights-of-way is a public use ease- ment for all existing underground and overhead public utilities, together with right of ingress and egress for the purpose of maintaining, replacing, and upgrading said existing public utilities. 4. That from and after the date this resolution is recorded with the Office of the Orange County Recorder, the described vacated rights-of-way no longer constitute public rights-of-way, except as provided in previous Paragraph 3. 5. The City Clerk is hereby instructed to withhold recording of this resolution with the Orange County Recorder until negotiations are concluded between the Costa Mesa Redevelopment Agency and the Teachers Retirement System for the State of Illinois regarding an easement for ingress and egress across Parcel A.
