Phinney, City Clerk Post Office Box 1200 Costa Mesa, CA 92628-1200 RESOLUTION NO. 92-64 Recorded June 24, 1992 Document No. 92-427323 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ORDERING THE VACA- TION OF 22 FEET OF PROPERTY AT 2417 ELDEN AVENUE. WHEREAS, the City Council of the City of Costa Mesa did, on the 18th day of May, 1992, adopt Resolution No. 92-46, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF 22 FEET OF PROPERTY AT 2417 ELDEN AVENUE"; and WHEREAS, pursuant to said Resolution of Intention, the time and place for hearing all persons interested in or objecting to the proposed vacation was set for Monday, the 15th day of June, 1992, at 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California; and WHEREAS, notices of said proposed vacation were duly and regularly posted as required by law, all pursuant to the provisions of Section 8300 et seq. of the Streets and Highways Code of the State of California; and WHEREAS, on said date of hearing, the proposed vacation came on regularly to be heard; all persons appearing on the proposed vacation were heard; and said hearing was closed on the 15th day of June, 1992; and WHEREAS, the Costa Mesa City Council finds and determines from all the evidence submitted that the hereinafter described right-of-way is unnecessary for present or prospective street purposes; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOWS: 1. That the hereinafter described right-of-way is unnecessary for present or prospective street purposes. 2. It is hereby ordered that the following described right-of-way be, and the same is hereby vacated: The northwesterly 22.00 feet of the southwesterly 82.00 feet of Lot 52 in Tract No. 300 in the City of Costa Mesa as shown on a map filed in Book 14, page 11 of Miscellaneous Maps, official records of Orange County, California, excepting the southwesterly 25.00 feet thereof. RESERVING THEREFROM a public use easement for all existing underground and overhead public utilities, together with right of ingress and egress for the purpose of maintaining, replacing, and upgrading said existing public utilities. All as more particularly shown on a map attached hereto and by this reference made a part hereof.
