Phinney, City Clerk Post Office Box 1200 Costa Mesa, CA 92628-1200 RESOLUTION NO. 92-73 Recorded July 27, 1992 Document No. 92-501866 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, SUMMARILY VACATING AN EXCESS RIGHT-OF-WAY FOR BICYCLE TRAIL PURPOSES AT 3505 CADILLAC AVENUE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, pursuant to Chapter 4 of Part 3 of Division 9 of the California Streets and Highways Code, the City Council may summarily vacate an excess right-of-way which is not required for street or highway purposes; and WHEREAS, based upon the substitution of a new 'bicycle trail easement for the existing bicycle trail easement, the City Council finds that the existing bicycle trail right-of-way located at 3505 Cadillac Avenue, and described as follows: A ten -foot wide easement for bicycle trail purposes over a portion of Parcel 1 as shown on Parcel Map 5-77-07 filed in Book 101, Pages 34-37, of Parcel Maps in the Orange County Recorder's Office, ' Orange C-ounty, California, a copy of which will be permanently maintained by the City Clerk, is excess and is not required for street or highway purposes; and WHEREAS, the Costa Mesa Planning Commission considered and found that vacation of the described right-of-way is consistent with the City's General Plan; and WHEREAS, the City Council finds that vacation of the described right-of-way is consistent with the City's General Plan; and WHEREAS, the City Council finds that the described right-of-way is not useful as a nonmotorized transportation facility, as defined in Section 156 of the California Streets and Highways Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: 1. The right-of-way described above is excess and not required for streets or highway purposes. 2. It is hereby ordered that the described right-of-way be and the same is hereby vacated, reserving therefrom a public easement for all existing underground and overhead public utilities together with right of ingress and egress for the purpose of maintaining, replacing and upgrading said existing public utilities. 3.
