HomeMy WebLinkAbout92-77 - Approving PA -92-51, Atrium at 3462 Windsor CourtX 190 RESOLUTION NO. 92-77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNING ACTION PA -92-51. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, as application was filed by Earl Baird, authorized agent for Robert L. Jones, with respect to real property located at 3462 Windsor Court, requesting an amendment to a Development Plan to allow enclosure of an atrium inside an existing residence in the PDR - MD zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on July 13, 1992, and by the City Council on August 3, 1992. NOW, THEREFORE, BE IT RESOLVED THAT, based on the evidence in the record and the findings contained in Exhibit "A", and subject to the conditions contained in Exhibit "B", the City Council hereby approves Planning Action PA -92-51 with respect to the property described above. BE IT FURTHER RESOLVED THAT the Costa Mesa City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon operation of the business or activity in the manner described in the Staff report for Planning Action PA -92-51, and upon applicant's compliance with each and all of the conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this Resolution, and any approvals herein contained, shall be deemed null and void. The information presented substantially complies with Costa Mesa Municipal Code Section 13-253 (4)(d) in that the proposed atrium enclosure is compatible with the intent and spirit of the Planned Development Ordinance and the Land Use Element of the General Plan. The proposed project will not be detrimental to the health, safety, comfort, convenience, and general welfare of the public in the neighborhood. B. The project, as conditioned, is consistent with Article 22- 1/2, Transportation Systems Management, of the Costa Mesa Municipal Code in that no intersection to which the project contributes measurable traffic shall operate at less than the Standard Level of Service as a result of project implementation. C. The project has been reviewed for compliance ,with the California Environmental Quality Act (CEQA), and the CEQA Guidelines, and the City Environmental procedures, and has been found to be exempt from CEQA because the project has no possibility of causing a significant effect. Approval of Planning Action PA -92-51 is valid for one (1) year and will expire at the end of that period unless building permits are obtained or the applicant applies for and is granted an extension of time. ORDINANCE AND/OR CODE PROVISIONS The following list of Federal, State, and local laws applicable to the project has been compiled by Staff for the applicant's reference. Ping. 1. All contractors and subcontractors must have valid business licenses to do business in thg City of Costa Mesa. Final occupancy and utility releases will not be granted, and final inspections will not be granted until such licenses have been obtained. 2. Development shall comply with all requirements of Article 17, Title 13 of the Costa Mesa Municipal Code. Eng. 3. A Site Access permit and deposit of $350.00 will be required by the City of Costa Mesa, Engineering Division, prior to the start of any on- or off-site work, which may be necessary during construction for street sweeping. Fire 4. Provide approved smoke detectors to be installed in accordance with the 1988 Edition of the Uniform Fire Code. 5. Provide address numerals which conform to Fire Department standards with respect to size (411) and location. Resolution No. 92-77 1
