HomeMy WebLinkAbout92-87 - Approving PA -92-64RESOLUTION NO. 92-87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNING ACTION PA -92-64. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Monighan and Associates, authorized agent for Ted Servais, with respect to real property located at 1726 Superior Avenue, requesting a Sign Variance to allow a change of copy on an existing nonconforming ground sign that exceeds allowable height and area requirements, in a Cl zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on August 24, 1992, and the request was denied; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", and subject to conditions contained in Exhibit "B", the City Council of the City of Costa Mesa hereby overturns the Planning Commission decision and approves Planning Action PA -92-64 with respect to the property described above. BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon the applicant's compliance with each and all of the conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this Resolution, and any approvals herein contained, shall be deemed null and void. IN WITNESS WHEREOF, I have hereunto set my hand and affixed the Seal of the City of Costa Mesa this 20th day of October, 1992. ej ity Clerk and ex -officio Clerk ofth City Council of the City of Costa Me RESOLUTION NO. 92-87 Planning Action PA -92-64 EXHIBIT "A" FINDINGS The information presented substantially complies with Section 5-127(a) of the Costa Mesa Municipal Code in that, because of special circumstances applicable to the property, including shape, topography, and location, the strict application of the ordinance deprives subject property privileges enjoyed by other property in the vicinity, and under identical zoning classification and other restrictions. Specifically: (a) the lot is highly irregular in shape and has no access to Newport Boulevard; (b) subject lot's elevation is depressed below Newport Boulevard; (c) total provided sign area for all wall as well as free-standing signs is less than that permitted by the Sign Ordinance; and (d) landscaping owned and maintained by CALTRANS would impede viewing a lower sign while traveling south on Newport Boulevard. EXHIBIT "B" CONDITIONS Planning: 1. Permits must be obtained for the face change as required. Ordinance and/or Code Provisions: The following Federal, State, and local laws applicable to the project has been compiled by staff for the applicant's reference. Planning: 1. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final occupancy and utility releases will not be granted, and final inspections will not be granted until all such licenses have been obtained.
