FINDINGS
A. The information presented substantially complies with
Costa Mesa Municipal Code Section 13-253 (4)(d) in that
the proposed request is compatible with the intent and
spirit of the Planned Development Ordinance and the Land
Use Element of the General Plan and would enhance the
health, safety, comfort, convenience, and general welfare
of the public in the neighborhood;
B. The information presented substantially complies with
Section 13-346 of the Costa Mesa Municipal Code in that
special circumstances applicable to the property exist to
justify granting the Variance from perimeter setback
requirements. Specifically, the proposed garages
necessitating the variance do not affect any residential
properties; the subject location backs up to a freeway
off ramp; and the additional wall would help provide a
buffering function from freeway noise. Strict
application of the zoning ordinance will not deprive the
property owner of privileges enjoyed by owners of other
property in the vicinity under identical zoning
classification.
C. The project is consistent with Article 22-1/20,
Transportation Systems Management, of the Costa Mesa
Municipal Code in that no intersection to which the
project contributes measurable traffic shall operate at
less than the Standard Level of Service as a result of
project implementation.
D. The project has been reviewed for compliance with
California Environmental Quality Act (CEQA), the CEQA
guidelines, and the City Environmental procedures, and
has been found to be exempt from CEQA because the project
has no possibility of causing a significant effect.
