HomeMy WebLinkAbout92-88 - Approving PA -92-45[1 RESOLUTION NO. 92-88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND THE VARIANCE FOR PLANNING ACTION PA -92-45. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Craig Combs Associates, authorized agent for Lucas Development Company, with respect to real property located at 550 Paularino Avenue, requesting a Conditional Use Permit to cover existing open parking spaces and a Variance from perimeter setback requirements for the structures to encroach into existing setback area, in the PDR -HD zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on July 13, 1992; and by the City Council on August 3, 1992, September 8, 1992, October 5, 1992, and October 19, 1992; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", and subject to the conditions contained in Exhibit "B", the City Council hereby approves the Conditional Use Permit and the Variance for Planning Action PA -92-45 with respect to the property described above. BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon operation of the business or activity in the manner described in the Staff report for Planning Action PA -92-45, and upon applicant's compliance with each and all of the conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this Resolution, and any approvals herein contained, shall be deemed null and void. The information presented substantially complies with Costa Mesa Municipal Code Section 13-253 (4)(d) in that the proposed request is compatible with the intent and spirit of the Planned Development Ordinance and the Land Use Element of the General Plan and would enhance the health, safety, comfort, convenience, and general welfare of the public in the neighborhood; B. The information presented substantially complies with Section 13-346 of the Costa Mesa Municipal Code in that special circumstances applicable to the property exist to justify granting the Variance from perimeter setback requirements. Specifically, the proposed garages necessitating the variance do not affect any residential properties; the subject location backs up to a freeway off ramp; and the additional wall would help provide a buffering function from freeway noise. Strict application of the zoning ordinance will not deprive the property owner of privileges enjoyed by owners of other property in the vicinity under identical zoning classification. C. The project is consistent with Article 22-1/20, Transportation Systems Management, of the Costa Mesa Municipal Code in that no intersection to which the project contributes measurable traffic shall operate at less than the Standard Level of Service as a result of project implementation. D. The project has been reviewed for compliance with California Environmental Quality Act (CEQA), the CEQA guidelines, and the City Environmental procedures, and has been found to be exempt from CEQA because the project has no possibility of causing a significant effect. Exhibit for Resolution No. 92-88 EXHIBIT "B" CONDITIONS Ping. 1. Approval of the Planning Action is valid for one (1) year and will expire at the end of that period unless building permits are obtained or the applicant applies for and is granted an extension of time. 2. Demolition permits for existing structure(s) shall be obtained and all work and inspections completed prior to issuance of building permits. 3. Landscaping, as approved by Planning Staff, will be provided in a one foot area between the garage and property line. Provided that adequate back-up areas exist from the fall of the garages. 4. The landscaping and the wall are to be maintained under the direction of Planning Staff. ORDINANCE AND/OR CODE PROVISIONS The following list of Federal, State, and local laws applicable to the project has been compiled by Staff for the applicant's reference. Ping. 1. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final occupancy and utility releases will not be granted, and final inspections will not be granted until all such licenses have been obtained. 2. Minimum garage door widths shall be as follows: single -garage - 9' double -garage - 18' 3. Development shall comply with all requirements of Article 17, Title 13 of the Costa Mesa Municipal Code. 4. Parking stalls shall be double -striped in accordance with City standards. 5. All compact parking spaces shall be clearly marked "compact" or "small car only". 6. The paving under required covered parking spaces shall be portland cement concrete (PCC). 7. Concrete wheel stops shall be installed 2' from the front edge of open parking spaces. 8. Two (2) sets of detailed landscape/ irrigation plans per the requirements set forth in Costa Mesa Municipal Code Sections 13-263 through 13-266, shall be submitted for review and approval by the Exhibit for Resolution No. 92-88 217 218 VA Bldg. Eng. Planning Division prior to issuance of any building permits. The two approved sets shall be attached to the two final building plan sets. Drought resistant vegetation together with a water conserving irrigation system shall be utilized. Landscaping shall be installed in accordance with the approved plan prior to release of utilities. 9. All landscaped areas shall be separated from paved vehicular areas by 6" high continuous Portland cement concrete curbing. 8. Comply with the requirements of the Uniform Building Code as to design and construction. 9. At the time of development submit for approval an Off-site Plan to the Engineering Division and Grading Plan to the Building Department that shows Sewer, Water, Existing Parkway Improvements and the limits of work on the site, and hydrology calculations, both prepared by a Civil Engineer or Architect.Site Access approval must be obtained prior to Building or Engineering Permits being issued by City of Costa Mesa. Pay Off-site Plan Check fee per Section 13-54, C.C.M.M.C. An approved Off-site Plan shall be required prior to Engineering/Utility Permits being issued by the City of Costa Mesa. 10. A Site Access permit and deposit of $500.00 will be required by the City of Costa Mesa, Engineering Division, prior to the start of any on- or off-site work, which may be necessary during construction for street sweeping.
