Exempt236 RESOLUTION NO. 92-93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, MAKING CERTAIN ENVIRONMENTAL FINDINGS IN CONNECTION WITH THE FINANCING OF THE COSTA MESA VILLAGE SINGLE ROOM OCCUPANCY HOUSING PROJECT. WHEREAS, Costa Mesa Village, Ltd., a California limited partnership ("Developer"), has contracted to purchase certain real property located within the City of Costa Mesa at 2450 Newport Boulevard (the "Property"), along with the improvements on the Property, including, among other things, the ninety-six (96) unit motel known as the Travelodge (the "Improvements"); and WHEREAS, the Developer desires to rehabilitate the Improvements and convert the units therein from hotel use to ninety-six (96) single -room occupancy ("SRO") units (the "Project") which will be made available at affordable housing cost to very low income households and one (1) management unit to be made available at affordable housing cost to a low income household; and WHEREAS, the Agency desires to provide financial assistance to Developer for land acquisition costs in the form of a loan for a total amount of Five Hundred Thousand Dollars ($500,000.00) (the "Loan"), utilizing approximately Three Hundred Thousand Dollars ($300,000.00) in funds borrowed from the Orange County Housing Authority (the "Authority") and Two Hundred Thousand Dollars ($200,000.00) in Community Development Block Grant funds borrowed from the City in order to extend its loan to the Developer as set forth in an Owner Participation Agreement between the Agency and the Developer; and WHEREAS, the City Council has reviewed the Preliminary Environmental Description prepared by the City Planning Division which recommends that the Project be found exempt from the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15061(b)(3); and WHEREAS, the City Council has reviewed the environmental assessment and the checklist of applicable statutes and regulations prepared by the County of Orange which recommended a finding that the activities of the Project are categorically excluded from the procedures of the National Environmental Policy Act of 1969 because the release of funds for the Project will not significantly affect the quality of the human environment; NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby resolve as follows: 1. Based on the Preliminary Environmental Description, the City Council finds that the Project is categorically exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Section 15061(b)(3). The City Council finds that there is no reasonable possibility that the Project may have a significant effect on the environment. 2. The City Clerk is hereby directed to file a Notice of Exemption from CEQA with the County Clerk of the County of Orange. 3. Based on the environmental assessment and the checklist of applicable statutes and regulations, the City Council finds that the release of funds for the Project will not significantly affect the quality of the human environment and is categorically excluded from the procedures of the National Environmental Policy Act of 1969. 1 4. The Planning Division is hereby directed to prepare a Finding of No Significant Impact and to publish and disseminate such findings in the manner required by 24 Code of Federal Regulations Part 58.43.
