HomeMy WebLinkAbout467 - Award of Contract - E. 17th Street Improvement District702 RESOLUTION N0. 467 RESOLUTInN OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AWARDING A CONTRACT FOR THE WORK DESCRTBED -N RESOLUTTON OF INTENTION NO. 441. RESOLVED: That the City Council of the City of Costa Mesa, at a regular meeting thereof held on the 21st day of April, 1958, publicly opened, examined and declared all sealed proposals or bids for the following work to be done in said City, to -wits The grading, paving, construction of curbs and gutters, concrete cross gutters, sanitary sewers, house connection sewers, manholes, water house connections, installat- ion of water mains and replacement of existing water mains, installation of certain pipe, structures and appurtenances for drainage purposes, relocation of fire hydrants, removal of certain obstructions together with appurtenances and appurtenant work in connection therewith, in East 17th Street and certain other streets and alleys in said City, all as more particularly described in Resolution of Intention No. 441, and in plans, profiles, drawings and diagram for the construction of said improvements, being Plan No. 7, consisting of 51 sheets, on file in the Office of the City Engineer of said City of Costa Mesa, and reference is hereby made to the specifications for the said work heretofore adopted by the said City Council and on file in the office of the City Clerk of said City, and all of said plans, profiles, drawings and specifications heretofore approved by the said City Council of the said City of Costa Mesa are in- corporated herein and made a part hereof, and reference is hereby made thereto for a more particular description of said work. Said City Council has determined and declared that the conterplated work and improvement heretofore mentioned was, in the opinion of the City Council, of more than local or ordinary public benefit and that said City Council has made the expense of said work and improvement chargeable upon the District. For the particular description of the said assessment district, reference is hereby made to said Resolution of Intention No. 441. Said City Council has determ'ned avd declared that serial bonds bearing interest at the rate of six par cent (6$ ) per annum and extending over a period ending nine (9) years from the second day of January next succeeding the next October 15th following their date, will be issued hereunder in the manner provided by the "Improvement Act of 1911', Division 7 of the Streets and Highways Code of the State of California, to represent each assessment of Fifty Dollars ($50.00) or more remaining unpaid for thirty (30) days after the date of the recordation of the warrant. The redemption provisions of said bonds shall require the payment of a premium of five per cent (5%) of the un- paid principal, and the words "together with a premium of five per cent (5%) of said unpaid principal" shall be added after the redemption clause in the bond form of the bonds issued. All of the work herkin ordered shall be done and carr'.ed through in pursuance of an Act of the Legislature of the State of California, designated the "Improvement Act of loll," being Division 7 of the Streets and Highwa�,s Code of the State of Calif- ornia. Said City Council hereby rejects all of the said proposals and bids excepting the next hereinafter mentioned, and hereby awards the contract for said work and imp- rovement to the lowest responsible bidder, to -wit: SULLY -MILLER CONTRACTING COMPANY, at the prices named in said bid for said work, on file in the Office of the City Clerk of said City. The City Clerk of said City is hereby directed to cause a Notice of Award of Contract to be published in the manner and form renuired by said Code, by two insert- ions in the Costa Mesa Globe -Herald and Pilot, a tri. -weekly newspaper published and circulated in the said City of Costa Mesa and hereby designated for the. purpose by the said City Council, and said City Clerk shall record the Notice of Award of Contract in the Office of the County Recorder for Orange County, State of California, in the manner and form provided for in Section 5248 of the Streets and Highways Code of the State of California.
