RESOLUTION NO. 36o
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA PETITIONING
THE DIRECTOR OF PUBLIC WORKS FOR APPROVAL OF EXPENDITURES AND SETTING
FORTH THE INADVERTENCE FOR FAILURE TO FOLLOW REQUIREMENTS IN RE SUPERIOR
AVENUE PROJECTS #2 AND #7.
WHEREAS, the City of Costa Mesa has heretofore applied to -the Director of
Public Works, State of California, pursuant to Sections #194 and #2107 of the Streets
and Highways Code, providing for the allocation of expenditure of gasoline tax funds
upon a major city street, to -wit Superior Avenue from the southerly city limits north-
east to 17th Street, and
#2, and
WHEREAS, the State did, by Memorandum of Agreement, approve said Project
WHEREAS, subsequent to said approval by the State of California the State
approved a revised and additional project, being Project #7, for said expenditure for
the reconstruction of said Superior Avenue, and
WHEREAS, subsequent to said approval by the State of California the City of
Costa Mesa did, by an inadvertence, obtain estimates of bids and did award the contract
and perform the work of reconstruction on said portions of said Superior Avenue, and
WHEREAS, said work has been completely performed and accepted by the City
of Costa Mesa, and
WHEREAS, through inadvertence, the City of Costa Mesa failed to forward far
approval to the Director of Public Works of the State of California, the Bids, Plans
and Specifications prier to awar& ng the Bid, and
WHEREAS, said failure and inadvertence was due to the fact that said Bids,
Plans and Specifications were forwarded to the State of California, Department of
Public Finance, for approval under Chapter #20 for the receipt of matching funds and
thereby inadvertently neglected to send duplicate copies of such Bids, Plans and
Specifications to the Director of Public Works, State of California, as required, and
WHEREAS, the City Council of the City of Costa Mesa feels that the expend-
iture would have been authorized had the information, to -wit the Bids, Plans and
Specifications, been submitted as required,
NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby re-
solve as follows:
SECTION 1. That the City Manager fortwith submit to the Director of Public
Works of the State of California the Bids, Plans and Specifications and all of the
,things necessary for the approval of the Superior Avenue Project, being #2 and P.

SECTION 2. That the City Council of the City of Costa Mesa finds and
determines that the failure to submit said Bids, Plans and Specifications to said
Director of Public Works of the State of California prior to the awarding of the
contract and the performance of the work was due to inadvertence, to -wit the send-
ing of said Bids, Plans and Specifications to the Director of Public Finance, State
of California, for Chapter #20 matching funds.
SECTION 3. That the City Council of the City of Costa Mesa, after examin-
ing the matter, feels that the expenditure would have been authorized had said Bids,
Plans and Specifications been suhmitted to the Director of Public Worts of the State
of California, as required, prior to the awarding of the contract and the performance
of work.
SECTT_ON 4. That the City Council hereby requests the Director of Public
Works of the State of California to accept the Bids, Plans and Specifications for
said Superior Avenue Project #2 and #7 and to make a finding by the State Highway
Engineer that the expenditure would have been authorized had this information been
submitted at the proper time and that the expenditure set forth in the Memorandum of
Agreement for said $oject be approved.
PASSED AND ADOPTED: this 6th day of May, 1957.
