HomeMy WebLinkAbout362 - West 19th Street Improvement - Ordering Omissions519 RESOLUTION NO. 362 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ORDERING CERTAIN OMISSIONS FROM AND DECREASES IN THE THINGS PROPOSED TO BE DONE AS SET FORTH IN THE REPORT FILED UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, AND FINDING THAT SUCH OMISSIONS AND DECREASES DO NOT INCREASE THE ESTIMATED COST BY MORE THAN ONE-TENTH OF THE TOTAL ESTIMATED COST. WHEREAS, this City Council has heretofore taken steps provided by Sections 2821, 2822 and 2823 of the Streets and Highways Code of the State of California; and WHEREAS, this City Council directed Laurence J. Thompson to procure the required information and prepare and present to this City Council the written report on the work and improvement, and said report has been presented and approved by this City Council; and WHEREAS, by Resolution, this City Council fixed a time and place for hearing by it on said report; and WHEREAS, notice of said hearing was mailed as required by said Division 4 of the Streets and Highways Code of the State of California; and WHEREAS, at the time and place so fixed a hearing was duly held by this City Council at which all written protests or objections were presented, read and all Epersons desiring to be heard thereon were heard, and this City Council gave all per- sons present an opportunity to be heard in respect to any matter relating to said re- port, said work or improvement, or any of the proceedings therefore; and WHEREAS, all persons desiring to appear and be heard at said hearing were heard, and said hearing has been regularly held; and WHEREAS, this Council adopted Resolution No. 361, determining the results of hearing, overruling protests, determining that the public interest, necessity and convenience require certain work or improvement of West 19th Street and certain other Streets or Easements substantially as set forth in the report on the project filed under the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, and determining that said pr -jest is feasible; and WHEREAS, this Council has found and determined that certain omissions from Land decreases in the things proposed to be done should be made; and WHEREAS, this Council has ordered the Engineer to make certain omissions from and decreases in the things proposed to be done as set forth in said report; and WHEREAS, said omissions and decreases in the things proposed to be done do not increase the estimated cost by more than one-tenth of the total estimated cost as stated in said report, 520 NOW, THEREFORE, THE CITY CCUNCIL OF THE CITY OF COSTA MESA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the following items of work be omitted from and decreased in the things proposed to be done as set forth in the report filed under Division 4 of the Streets and Highways Code of the State of California: SEWER CONNECTIONS (a) Assessment #337 one sewer connection (b) Assessments #446 and #447 18 sewer connections (c) Assessment #445 10 sewer connections (d) Assessment #3 one sewer connection (e) Assessment #494 one sewer connection (f) Assessment #431 one sewer connection (g) Assessment #383 13 sewer connections (h) Assessments # 1 and #2 one sewer connection each (i) Assessment #212 one sewer connection (j) Assessments #153 and #155 one sewer connection each (k) Assessment #19 one sewer connection (1) Assessment #15 one sewer connection (m) Assessment #13 one sewer connection (n) Assessment #12 one sewer connection (o) Assessment #21 one sewer connection (p) Assessment #22 four sewer connections WATER CONNECTIONS (a) Assessment #383 six water connections (b) Assessment #212 one water connection (c) Assessments #446 and #447 12 water connections (d) Assessment #445 10 water connections (e) Assessment #15 one water connection (f) Assessment #13 one water connection (g) Assessment #12 one water connection STORM DRAIN PIPE AND STRUCTURES OVER AND ALONG THE FOLLOWING PARCELS: Assessment #68 Assessment #129 Assessment #211 SANITARY SEWER The elimination of the following sanitary sewer: On Wallace Street between Center Street and West loth Street over and across Assessment #447 and Assessment #448. SECTION 2. That said omissions and decrease in said work do not increase the estimated cost by more than one-tenth of the total estimated cost as set forth in said report.
