HomeMy WebLinkAbout364 - West 19th Street Improvement - Resolutioin of Intention593 RESOLUTION OF INTENTION NO. 364 RESOLUTION OF THE CITY COI.NCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE GRADING, PAVING AND OTHERWISE IMPROVING WEST 19TH STREET AND CERTAIN OTHER STREETS AND EASEMENTS IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THL COSTS AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK. The City Council of the City of Costa Mesa, pursuant to the provisions of the "Improvement Act of 1911', being Division 7 of the Streets and Highways Code of the State of California, does resolve as follows: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Costa Mesa, California, to order the following work to be done, to -wit: DESCRIPTION OF WORK FIRST: The grading, paving with sealed coat surfacing, paving with plant mixed surfacing material over rock base, construction of cement concrete combination curbs and gutters, cement concrete cross gutters, vitrified clay pipe house connect- ion sewers, copper tubing water service house connections, reinforced concrete pipe storm drain, catch basins, corrugated metal pipe culvert, reconstruction of existing sewer manholes to grade, installation of blind flange in cast iron pipe, removing obstructions, including existing pavement, plant mix berms, and concrete vault, and appurtenant work in connection therewith; In 16th STREET between Placentia Avenue and Superior Avenue, as shown on Sheets Nos, 3, 49 14, 18 and 29 of said plans. SECOND: The grading, paving with plant mixed surfacing material over rock base, construction of cement concrete combination curbs and gutters, removing obstruct- ions, including existing pavement, plant mixed berm, and guard panel, and appurtenant work in connection therewith, In that portion of SUPERIOR AVENUE extending 110 feet southwesterly and 30 feet northeasterly from the center line of 16th Street, as shown on Sheets Nos. 4 and 18 of said plans. THIRD: The grading, paving with plant mixed surfacing material over rock base, construction of cement concrete combination curbs and gutters, cement concrete gutter, cement concrete cross gutters, vitrified clay pipe house connection sewers, 5z4 copper tubing water service house connections, reinforced concrete pipe storm drain, catch basins and appurtenances, corrugated metal pipe fan inlet and outlet, corrugated metal pipe culvert, reconstruction of existing sewer manholes to grade, removing obstructions, including existing, pavement, curb and gutter, and appurtenant work in connection therewith; In 17th STREET between Placentia Avenue and Superior Avenue, as shown on Sheets Nos. 5, 6, 15, 19, 30 and 31 of said plans. FOURTH; The grading, paving with sealed coat surfactng, paving with plant maxed surfacing material over rock base, construction of cement concrete combination curbs and gutters, cement concrete spandrels, cement concrete cross gutters, vitrified clay pipe house connection sewers, copper tubing water service house connections, re- inforced concrete pipe storm drain, catch basins, corrugated metal pipe culverts, vit- rified clay pipe sewer main, drainage manholes, sewer manhole, reconstruction of existing sewer manholes to grade, reconstruction of cement concrete curb, removing obstructions, including existing pavement, concrete curb, corrugated metal pipes, guard panel, trees, driveways and walks, and appurtenant work in connection therewith; In that portion of 18th STREET between Placentia Avenue and 140.70 feet east of the center line of Anaheim Avenue, as shown on Sheets Nos. 7, 8, 9y 16, 20, 23, 26 and 32 of said plans. FIFTH: The grading, resurfacing existing pavement with plant mixed sur- facing material, paving with plant mixed surfacing material over rock base, construct- ion of cement concrete combination curbs and gutters, cement concrete cross gutters, vitrified clay pipe house connection sewers, copper tubing water service house connect- ions, catch basins, corrugated metal pipe culvert, reconstruction of existing sewer manholes to grade, relocation of fire hydrants, removing obstructions, including exist- ing pavement, curbs and getters, corrugated metal pipes, fences, plant mixed berms, trees, driveways and walks, and appurtenant work in connection therewith) In WEST 19TH STREET between Placentia Avenue and Harbor Boulevard, as shown on Sheets Nos. 10, 11, 12, 13, 17, 21, 24 and 27 of said plans. 5'25' SIXTH: The grading, resurfacing existing pavement with plant mixed surfacing material, paving with plant mixed surfacing material over rock base, construction of cement concrete combination curbs and gutters, removing obstruct- ions, including concrete curbs and gutters, and appurtenant work in connection therewith; ` In L HARBOR BOULEVARD extending 42 feet north and 44 feet south from the center line of West 19th Street, as shown on Sheet No. 13 of said plans. SEVENTH: The grading, resurfacing of existing pavement with plant mixed surfacing material, paving with plant mixed surfacing material over rock base, construction of cement concrete combination curbs and gutters, cement concrete cross gutters, cement concrete spandrels, vitrified clay pipe house connection sewers, copper tubing water service house connections, catch basins, corrugated metal pipe culverts, reconstruction of existing sewer manholes to grade, grading existing drainage ditches and shoulder, removing obstructions, including existing pavement, plant mixed berm, trees, corrugated metal pipe culverts, hedgerows and driveways, and appurtenant work in connection therewith; In that portion of PLACENTIA AVENUE extending 330 feet south of the center line of 16th Street to 57 feet north of the center line of West 19th Street, as shown on Sheets Nos. 3, 5, 7, 10, 14, 15, 16 and 17 of said plans. TWELFTH: The grading, paving with sealed coat surfacing, paving with plant mixed surfacing material over rock base, construction of cement concrete combination curbs and gutters, cement concrete cross gutter, removing obstructions, incl ding existine pavement, curbs and gutters, trees, plant mixed berms, driveways and walks, and appurtenant work in connection therewith; In PLUMER STREET between Anaheim Avenue and Park Avenue, as shown on Sheets Nos. 21, 24 and 27 of said plans. THIRTEENTH: The grading, paving with plant mixed surfacing material over rock base, construction of cement concrete combination curbs and gutters, cement concrete cross gutter, vitrified clay pipe house connection sewers, copper tubing water service house connections, sewer manholes, vitrified clay pipe sewer main, removing obstructions, incLuding existing pavement, trees, cement block wall foot- ing, concrete curb and gutter, driveways and walks, and appurtenant work in conn- ection therewith; In of said plans. FOURTEENTH: The grading, paving with plant mixed surfacing material over rock base, construction of cement concrete curbs, cement concrete cross gutter, re- moving obstructions, including existing pavement, curbs, cross gutter, curb and gutter, plant mixed berm, and appurtenant work in connection therewith,- In herewith; In that portion of VIOLA PLACE extending 45 feet north from the center line of 18th Street, as shown on Sheet No. 8 of said plans; and in that portion of CRESTMONT PLACE extending 45 feet south of the center line of 18th Street, as shown on Sheet No. 8 of said plans; and in that portion of mcn.n-rn+n. urn, extending 47 feet west from the center line of Anaheim Avenue, as shown on Sheet No. 22 of said plans; and in that portion of RENW00D PLACE WEELO DRIVE between Wallace Avenue and Pomona Avenue, as shown on Sheets Nos, 20, 26 and 28 of said plans. FOURTEENTH: The grading, paving with plant mixed surfacing material over rock base, construction of cement concrete curbs, cement concrete cross gutter, re- moving obstructions, including existing pavement, curbs, cross gutter, curb and gutter, plant mixed berm, and appurtenant work in connection therewith,- In herewith; In that portion of VIOLA PLACE extending 45 feet north from the center line of 18th Street, as shown on Sheet No. 8 of said plans; and in that portion of CRESTMONT PLACE extending 45 feet south of the center line of 18th Street, as shown on Sheet No. 8 of said plans; and in that portion of mcn.n-rn+n. urn, extending 47 feet west from the center line of Anaheim Avenue, as shown on Sheet No. 22 of said plans; and in that portion of RENW00D PLACE � 528 extending 45 feet south from the center line of 18th Street, as shown on Sheet No. 9 of said plans; and in that portion of MEYER PLACE extending 57 feet north from the center line of West 19th Street, as shown on Sheet No. 11 of said plans; and in that portion of MAPLE AVENUE extending 57 feet north from the center line of West 19th Street, as shown on J Sheet No. 12 of said plans; and in that portion of PARK DRIVE extending 55 feet east from the center line of Anaheim Avenue, as shown on Sheet No. 23 of said plans; and in that portion of PARK AVENUE extending 57 feet south from the center line of West 19th Street, as shown on Sheets Nos. 12 and 27 of said plans. FIFTEENTH: The construction of reinforced concrete pipe storm drain, guard posts, drainage manholes, catch basins and appurtenances, filling ditch to grade, and appurtenant work in connection therewith, in the following public easements, to - wit: In the IDURIDT ,169 over and across the easterly 10 feet of Lot 505, Newport Mesa Tract, as shown on a map thereof, recorded in T"i.scellaneous Maps, Book 5, page 1, Records of Orange County, California, as shown on Sheets Nos. 8 and 32 of said plans; and In the EASEMENT over and across the easterly 10.00 feet of the westerly 162.50 feet of Lot 507 and Lot 508, Newport Mesa Tract, as shown on a map thereof, recorded in Miscellaneous Maps, Book 5, page 1, Records of Orange County, California, as shown on Sheet No. 31 of said plans; and In the EASEMENT over and across a strip of land 10.00 feet in width being five feet on both sides of and adjoining, the following described line: Beginning at a point in the southerly line of Lot 612, as shown on a map of Newport Mesa Tract, recorded in Book 5, page 1, of Miscellaneous Maps, Records of Orange County, California, 112.00 feet westerly from j the southeasterly corner of said Lot 612; thence northerly in a direct line to a point in the northerly line of said lot, 145 feet westerly of the northeasterly corner thereof; thence northerly in a direct line to a point in the northeasterly line of Lot 611, of said Newport Mesa Tract, 215.00 feet westerly of the northeasterly corner of said lot, as shown on Sheet No. 29 of said plans; and In the EASEMENT over and across a stain of land 10.00 feet in width being five feet on both sides of and adjoining the following described line: Beginning at a point in the centerline of Superior Avenue (60.00 feet wide) said point being 62.83 feet southwesterly from the centerline intersections of Superior Avenue and Pomona Avenue; thence northwesterly 190.05 feet more or less, to a point in the centerline of Sixteenth Street (60.00 feet wide) said point being 138.70 feet westerly from the centerline intersections of Sixteenth Street and Pomona Avenue. EXCEPTTNG all portions included within Sixteenth Street and Superior Avenue, as shown on Sheet No. 29 of said plans. There is specifically excepted from any and all of the above described items of improvement any port4on of the said work already constructed and existing to line and grade within the streets hereinabove described. PLANS, PROFILES, DRAWINGS AND SPECIFICATIONS at the places and in the manner shown on the plans, profiles and drawings for the construction of said improvements in West 19th Street and certain other streets and easements, being Plan No. 5, consisting of 36 sheets, on file in the office of the City Engineer of said City, and except as otherwise provided on said plans in further accordance with the Specifications for the construction of said improvements, said Specifications being on file in the office of the City Clerk of said City, and to which plans, profiles, drawings and specifications heretofore approved by the City Council of said City, reference is hereby Tade for a further, full and more particular des- cription of said work, and by reference thereto the same are incorporated herein and made a part hereof. SECTION 2. All of the said work and improvement to be done, shall be DISTRICT constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, profiles and drawings for the construction of said improvements in West 19th Street and certain other streets and easements, being Plan No. 5, consisting of 36 sheets, on file in the office of the City Engineer of said City, and except as otherwise provided on said plans in further accordance with the Specifications for the construction of said improvements, said Specifications being on file in the office of the City Clerk of said City, and to which plans, profiles, drawings and specifications heretofore approved by the City Council of said City, reference is hereby Tade for a further, full and more particular des- cription of said work, and by reference thereto the same are incorporated herein and made a part hereof. of the said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the said work and improvement charge- able upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the DESCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the said contemplated work and improvement, in the opinion of the said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the said work and improvement charge- able upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the 530 costs and expenses thereof, and which district is described as follows: All that certain territory of the City of Costa Mesa, California, exclusive of streets and alleys, incladed within the exterior boundary line shown upon that certain Map or Plat No. 5, consisting of 6 pages, attached to and forming a part of the Investigation Report prepared and filed under the provisions of the 'Special Assessment Investigation, Limitation and Majority i-rotest Act of 1931', Division 4 of said Streets and highways Code, heretofore approved by the City Council of said City of Costa Mesa on the 1st day of April, 1957, indicating by said boundary line the extent of the territory included within the proposed assess- ment district, and which map or plat is on file in the office of the City Clerk of said City. Reference is hereby made to said map or plat for a further, full and more particular description of the said assessment district, and the said map or plat so on file shall govern for all details as to the extent of the said assess- ment district. DESCRIPTION OF BONDS SECTION 4. That serial bonds bearing interest at the rate of six per cent (69) per annum shall be issued to represent each assessment of Twenty Five Dollars (."25.00) or more, remaining unpaid for thirty (30) days after the date of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October Fifteenth following their date. Payments on the principal of unpaid assessments and interest thereon shall be made by the property owners to the City Treasurer, and the same shall be disbursed by said City Treasurer, all as provided in the "Improvement Act of 1911" hereinafter referred to. TIME AND PLACE OF HEARING SECTON 5. NOTICE IS HEREBY GIVEN that on the 17th day of June, 1957, at the hour of seven -thirty (7:30) o'clock P.M., in the Council Chamber of the City Council, in the Justice Court Building, at 567 West 18th Street, in said City of Costa Mesa, any and all persons having any protests or objections to the proposed work or improvement, or to the extent of the assessment district, or to the proposed grades, may a^pear and show cause why said work should not be done or carried out in accordance with this Resolution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IMPROVEMENT ACT SECTION 6. That all of the work herein proposed shall be done and carried through in pursuance of an Act of the Legislature of the State of California, design- ated the "Improvement Act of 1911", being Division 7 of the Streets and Highways Code of the State of California. 531 PUBLICATION OF RESOLUTION OF INTENTION SECTION 7. The Costa Mesa Globe -Herald, a tri -weekly newspaper, printed, published and of general circulation in the City of Costa Mesa, California, is hereby designated as the newspaper in which this Resolution of Intention shall be published �r by the City Clerk, in the manner and form provided by law, and for making all other i publications in the proceedings under this Resolution of Intention. L The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed whose names and addresses appear on the last equalized assessment roll for City taxes, all in the manner and form provided for under Sections $070, 5194 and 5195 of the said "Improvement Act of 1911" of said Streets and Highways Code, POSTING OF NOTICE OF IMPROVEMENT SECTION 8. The Superintendent of Streets of the City of Costa Mesa shall cause to be conspicuously posted along the line of said contemplated work or imp- rovement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention, in the time, form and manner provided by said Code. INVESTIGATION REPORT SECTION 9. That the written report of the Assessment Engineer on the proposed improvements herein described and prepared pursuant to the provisions of the 'Special Assessment, Investigation, Limitation and Majority Protest Act of 193111, being Division 4 of the Streets and Highways Code of the State of California, is on file in the office of the City Clerk of said City and is open to public inspection. ESTIMATE OF THE TOTAL COST OF THE PROPOSED WORK SECTION 10. The estimated total cost of the proposed work is $$414,357.57.
