TEPEAS, the Citi• Council of the Cite of Costa Yesa did, on the 20th day of
'gay, 057, adopt Resoluti on of Intention No. 364 far the grading, paving, construction
of curbs and gutters, concrete cross Fitters, sanitary sewers, house connection sewers,
manholes, water horse connections, relocation of fire hydrants, installation of certain
pipe, structures and appurtenances for drainage purposes, reroval of certain obstructions,
and ar;purtenant wor}c in connection therewith in West 19th Street and certain other
streets and easements in said Cit;,; and
WHEREAS, pursuant to the provisions of Section 1773 of the Labor Code of the
State of California it is necessary that th City Council of the City of Posta Fesa
ascertain and deterrine the general prevailing rate of per diem wanes in the locality,
anc; the provisions of the said Code make it r.andatory upon the awarding body of any
public contract where said boder substantially calls for bids for any public improvement,
to ascertain and determine the general prevailin7 rate of per diem gages in the locality
in which the public work is to be performed for each craft, classification or kind of
+_. workman or mechanic needed to execrate the contract, and also the general prevailing rate
for holiday and overtime work in the locality for each craft, classification or type of
work -an or mechanic in accordance with the schedule attached hereto; and
WHEREAS, said Section 1773 of the Labor Code of the State of California requires
the awarding body, in determining such rates, to ascertain and consider the applicable
ware rates established by collective bargaining agreements and such rates as may have
been predeterm;ned by Federal public work within the locality and in the nearest labor
market area and where such rates do not constitute the rates actually prevailing in the
locality that the awarding body shall obtain and consider further data from labor organ-
izations, employers or employer associations concerned, including the recognized collect-
ive bargaining representatives for the particular craft, classification or type of work
involved.
NOW, VIREFORE, The City Council of the City of Costa Mesa has ascertained and
does hereby determine that the nenoral prevailing rate of per diem gages in the locality
in whish said work described is to be performed in the &Trovement of WeV 19th Street and
certain other streets and easements, for each raft, ciassifi cation or tyre of workman
or mechanic needed to execute the contract, and also the general prevailing rate for
holiday and rverti me work for each craft classification or tape of workman or mechanic
