Home My WebLink About388 - Street Lighting District - Ordering WorkR.:7 RESOLUTION NO. 388 A RESOLUTION OF THE C -TY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CONFIRMING THE REPORT OF THE CITY ENGINEER DATED JUNE 24, 1957, PREPARED PURSUANT TO THE PROVTSIONS OF THE "STREET LIGHTING ACT OF 1019", AND REFERRED TO IN RESOLUTION N0. 377 OF SAID COUNCIL, ANL THE PLANS AND SPECIFICATT_ONS, ESTIMATE, DIAGRAM AND ASSESSMENT CONTATNED IN SAID REPORT: ORDERING THE WORK ANL LEVYING THE ASSESSMENT FOR SERVICE NECESSARY TO MAINTAIN AND ILLUMINATE BY ELECTRIC ENERGY THE STREET LIGHTS WT.THTN SAID CITY FOR THE PERIOD OF MONTHS END- ING OCTOBER 31, 1958. WHEREAS, the Cit? Council of the City of Costa Mesa, California, did in a Resolution adopted by said Council on the 4th day of February, 1957, Pur- suant to the provisions of the "Street Li-hting Act of 1019" of the State of Calif- ornia, wh+ch is now included as Part 1 of Division 14 of the Streets and Highways Code of the State of California, requiring the City Engineer of said City to make and file with the Clerk of said Council a report in writing, presenting certain matters relating to a proposed lighting, maintenance and service district in said City, as contemplated under the provisions of said Act; and WHEREAS, the City Engineer pursuant to the requirements of said Council as set forth in said Resolution No. 324 of February 4, 1957, did make, and on the 24th day of June, 1957, did file in the office of the City Clerk (who is ex -officio Clerk of the City Council) of said City, his report in writing responsive to the re- quirements of said Resolution of February 4, 1057 relating to the proposed lighting, maintenance and service district in said City referred to in said Resolut on of Int- ention No. 377, and as contemplated under the prov'sions of said "Street Lighting Act of 1019"; and WHEREAS, the said City Council did, in Resolution No. 376 of said Council, approve said report on the 24th day. of June, 1957, in conformity with the provisions of said Act; and WHEREAS, said Council did thereafter, and on said 24th day of June, 1957, pass its Resolution of Intention No. 377, declaring its intention to order cert- ain lighting fixtures and appliances on certain streets and public places within said City to be maintained and electric current to be furnished for lighting said fixtures Efor a period of months ending October 31, 1058; and WHEREAS, said Council did also on said 24th day of June, 1957, in its Resolution No. 378, fix and desi.pnate Monday, the 20th day of July, 1957, at the hour of 7:30 P.M. of said day, as the time for hearing protests in reference to the pro- posed improvement and assessme^.t; and 5°70 WHEREAS, at the time and place above stated for hearing protests in reference to the pro--L.,osed improvement and assessment, said Council did proceed to hold and did hold said hearing; and WHEREAS, at the time and place above stated for hearing protests in reference to the proposed improvement and assessment, no protests or objections, either written or oral, were submitted or made; and WHEREAS, said Council having held said hearing and being fully advised in the premises, has now acquired jurisdiction to proceed further; NOW, THEREFORE, the City Council of the City of Costa Mesa, Calif- ornia, does resolve, declare find, determine and order as follows: Section 1. That said Council does hereby approve, confirm and adept the said report of said City Engineer dated the 24th day of June, 1957, and does approve and confirm the assessment proposed for said proposed improvement set forth and referred to in said report, which said report is now on file in the office of the City Clerk of said City, open to public inspection, hereby referred to and made a part hereof; and said City Council does hereby also confirm and adopt the respective instruments therein contained and designated Diagram and Plan No. 57-58, Specifications No. 57-58, Estimate, Diagram and Assessment, all of which on file as aforesaid are hereby incorporated herein and made a part hereof. Section 2. That said Council does hereby order and determine that the period of months referred to in said Resolution of Intention No. 377, shall be and the sa?.e is hereby fixed and established as the period of months ending on the 31st day of October, 1958, as therein set forth; and said Council does hereby levy the said proposed assessment made to cover the costs and expenses of said improvement upon the respective several subdivisions of land in the assessment district described and referred to in said Resolution of Tntention No. 377, and as fixed and determined by the sa'd report of June 24, 1057, and the prorosed assessment filed therewith as aforesaid, which said proposed assessment shall be for the period of months as above designated. Section 3. That the Cit}• Clerk of said City is hereby ordered to transmit, or cause to be transmitted, to the County Auditor of Orange County, California, as contemplated under the provisions of said "Street Lighting Act of 191911, the said diagram and assessment upon which such levy is based; and the County Tax Collector of said County (who is also the City Tax Collector for said City) is hereby designated, requested, empowered, authorized, instructed and directed to make collect- ion of all assessments shown in said assessment, and to perform the acts and duties 5'71 as are required by law of and to be performed by the officer, employee or person so designated. Section 4. That the City Clerk shall certify to the passage and adoption of this Resolution, shall cause the same to be entered among the original resclut`ons of said City; and shall make a minute of the passage and adoption thereof Section 5.
