RESOLUTION NO. 423
A RESOLUTION OF THE CIT`_' COUNCIL OP THL CITY OF COSTA MESA RECOKMENDING
ACTION BY TEL ORANGE COUNTY PLANNING CCIA1ISSION ON THE REZONING OF TBE
AREA ICIOWN AS "MESA ANNEXATION #2"
WHEREAS, an annexation election to the City of Costa Mesa was held on
October 11, 1956, in the
area
(mown
as "Mesa Annexation No.
2," being
that area
within a reasonable
lying between Placentia
Avenue
and
slightly west of Whittier
Avenue,
and between
16th Street and 19th Street; and
W?iERLAS, a majority in said election voted to annex said terrtitory to
the City of Costa Mesa; and
WHEREAS, the City of Newport Beach filed a suit contesting said annex-
ation proceedings, which litigation is still in process; and
ated; and
WHEREAS, it will be considerable time before said litigation '_s termin-
WHEREAS, the City Council feels that it would be for the best interests
of said area, and the people residing therein, and owning property therein, to have
the area zoned properly; and
WHEREAS, the City Council of the City of Costa Mesa dic at all times put
itself on record as favorinF the zoning desjired by the majority of the people
residing and. owning property in said area, and
IJHE'.EAS, petitions by said owners of property have been made to the
County of Orange for the rezcni_ng of certain parts of said area;
NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby
resolve as follows:
SECTION 1. That the Count7, of Orange, through its Planning Commission
and Board of Supervisors, act upon the petitions for the rezoning of the above des-
cribed area, and that such action be based upon the desires of the majority of the
owners and residents therein.
SECTION 2. That the City Council feels that it will be detrimental to
the residents and osmers of property in said area to have all action on rezoning
withheld until the terr:ination
of the pending litigation, for
the reason that it
cannot be ascertained that said
litigation will be terminated
within a reasonable
time.
