RESOLUTION NO. 439
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CAL_TFORNIA, ORDERING CERTAIN ADDITIONS, ALTERATIONS, OM-
ISSIONS FROM AND DECREASES IN THE THINGS PROPOSED TO BE
DONE AS SET FORTH IN THE REPORT FILED UNDER DIVISION 4
OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIF-
ORNIA, AND FINDING THAT SUCH ADDITIONS, ALTERATIONS, OM-
ISSIONS AND DECREASES DO NOT INCREASE THE ESTIMATED COST
BY MORE THAN ONE-TENTH OF THE TOTAL ESTIMATED COST.
WHEREAS, this City Council has heretofore taken steps provided by Sections
2821, 2822 and 2823 of the Streets and Highways Code of the State of California, and
WHEREAS, this City Council directed Laurence J. Thompson to procure the re-
quired information and prepare and present to this City Council the written report on
the work and improvement, and said report has been presented and approved by this City
Council; and
WHEREAS, by Resolution, this City Council fixed a time and place for hearing
by it on said report; and
WHEREAS, notice of said hearing was mailed as required by said Division 4
of the Streets and Highways Code of the State of California; and
WHEREAS, at the time and place so fixed a hearing was duly held by this
City Council, at
which
all written protests or objections
were
presented, read and all
persons desiring
to be
heard thereon ware heard, and this
City
Council gave all persons
present an opportunity to be heard in respect to any matter relating to said report,
said work or improvement, or any of the proceedings therefor; and
WHEREAS, all persons desiring to appear and be heard at said hearing were
heard, and said hearing has been regularly held; and
WHEREAS, this Council adopted Resolution No. 427, determining the results of
hearing, overruling protests, determining that the public interest, convenience and
necessity require certain work or improvement of East 17th Street and Certain Other
Streets and Alleys substantially as set forth in the report on the project filed under
the "Special Assessment Investigation, Limitation and Majority Protest Act of 1031,"
and determining that said project is feasible; and
WHEREAS, this Council has ordered the Engineer to make certain additions,
alterations, imissions from and decreases in the things proposed to be done as set
forth in said report; and
WHEREAS, said additions, alterations, omissions from and decreases in the
things proposed to be done do not increase the estimated cost by more than one-tenth

WHEREAS, this Council has ordered the Engineer to make certain additions,
alterations, imissions from and decreases in the things proposed to be done as set
forth in said report; and
WHEREAS, said additions, alterations, omissions from and decreases in the
things proposed to be done do not increase the estimated cost by more than one-tenth

of the total estimated cost as stated in said report.
NOW, THEREFORE, THE CITY COUNCIL OF THE CTTY OF COSTA MESA, DOES HEREBY
RESOLVE AS FOLLOWS:
SECTTON
1. That the following items of work be added, omitted from and
decreased in
t',e things proposed to be done as set forth in the report filed under
Division 4 of
the Streets and Highways Code of the State of California, and certain
additions and
alterations made as follows:
A.
The addition of 146 feet of cement concrete combination curbs and
gutters on Parcel No. 115, as shown on the diagram, on the South-
easterly side of Santa Ana Avenue between 15th Street and 16th Street.
B.
The elimination of paving and the construction of alley aprons in the
alley between Tustin Avenue and Irvine Avenue Northeasterly of 17th
Street.
C.
The elimination of paving, construction of curbs and gutters, house
connection sewers and water service house connections on Irvine Avenue
between 16th Street and 17th Street in front of Parcels 489 and 490,
as shown on diagram.
D.
The elimination of paving on Tustin Avenue between 17th Street and 18th
Street in front of Parcels 977, 978, 980, 981, a portion of 982, and a
portion of 532, as shown on diagram.
E.
The elimination of 425 feet of 18" reinforced concrete pipe storm drain
located on 16th Street and Orange Avenue in front of Parcels 245, 246,
247 and 248.
F.
The elimination of two catch basins located, respectively, at the inter-
section of Orange Avenue and 16th Street, and on 16th Street approximately
300 feet Northwesterly of its intersection with Orange Avenue.
G.
The elimination of the following hose connection sewers:

estimated cost as set forth in said report.
APPROVED AND ADOPTED this 10th day of February, 1958.
