HomeMy WebLinkAbout441 - E. 17th Street Improvement District - Resolution of Intentiona' l RESOLUTION OF INTENTION NO. 441 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE GRADING, PAVING AND OTHERWISE IMPROVING EAST 17TH STREET AND CERTAIN OTHER STREETS AND ALLEYS IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK. The City Council of the City of Costa Mesa, pursuant to the provisions of the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California, does resolve as follows: SECTION 1. SECOND: The grading, paving with plant mixed surfacing material over rock base and seal coat, construction of cement concrete combination curbs and gutters, cement concrete cross gutters, cement concrete spandrels, vitrified clay pipe house connection sewers, copper tubing water service house connections, transite pipe water main and appurtenances, reinforced concrete pipe stormdrain and drainage manhole, cement concrete alley apron, reconstruction of existing sewer manholes to grade, re- location of fire hydrants, removing obstructions, including existing pavement, trees, corrugated metal pipes, water rain, concrete driveways and walks, and appurtenant work in connection therewith; 651 In SANTA ANA AVENUE between the centerline of 15th Street and 177.2 feet Northeasterly from the center- line of 18th Street, as shown on Sheets Nos. 8, 9, 10, 11, 20, 22, 27, 31 and 49 of said plans. ELEVENTH: The grading, paving with plant mixed surfacing material over rock base and seal coat, resurfacing existing pavement with plant mixed surfacing material and seal coat, construction of cement concrete combination curbs and gutters, cement concrete cross gutters, cement concrete spandrels, reconstruction of existing sewer vanholes to grade, relocatiaa of existing fire hydrant, removing obstructions, including existing pavement, concrete driveways and walks, and appurtenant work in connection therewith; In PALMER STREET between Orange Avenue and Santa Ana Avenue, as shown on Sheets Nos. 3°, 45 and 48 of said plans. FOURTEENTH: The grading, paving with plant mixed surfacing material over rock base and seal coat, construction of cement concrete combination curbs and gutters, cement concrete cross gutters, vitrified clay pipe house connection sewers, copper tubing water service house connections, transite pipe water main and appurtenances, cement concrete alley aprons, installation of fire hydrant, relocation of fire hydrants, re -construction of existing sewer manholes to grade, removing obstructions, including existing pavement, fire hydrants, trees, hedge, plant mixed berm, curb and gutter, cross gutter, water main, fences, and appurtenant work in connection therewith; In CABRILLO STREET between Newnert Boulevard and 45 feet Southeasterly from the centerline of Orange Avenue, as shown on Sheets Nos. 6, 42, 0 and 44 of said plans. FIFTEENTH: The grading, paving. with plant mixed surfacing material over rock base and seal coat, construction of cement concrete combination curbs and gutters, cement concrete cross gutters, vitrified clay pipe house connection sewers, copper tubing water service house connections, transite pipe water main and appurtenances, reconstruction of existing sewer manholes to grade, removing obstructions, including existing pavement, spandrels, hedges, trees, plant mixed berms, and appurtenant work in connection therewith; In FULLER TUN AVENUE between 17th Street and Cabrillo Street, as shown on Sheets Nos. 25, 42 and 44 of said plans. SIXTEENTH: The grading-, paving with plant mixed surfacing material over rock base and seal coat, construction of cement concrete combination curbs and gutters, cement concrete cross gutters, reconstruction of existing sewer manholes to grade, remov;ng obstructions, including existing pavement, plant mixed berms, cement driveways and walks, trees, fences and appurtenant work in connection there- with; In WELLS PLACE between Fullerton Avenue and Cabrillo Street, as shown on Sheets Nos. 42 and 44 of said plans. 11 SEVENTEENTH: The grading, paving with plant mixed surfacing material over J rock base and seal coat, construction of cement concrete combination curbs and gutters, cement concrete cross gutter, cement concrete spandrel, cement concrete alley apron, reconstruction of existing sewer manholes to grade, removing obstruct- ions, including existing pavement, hedges, posts, fences, and appurtenant work in connection therewith; In WESTMINSTER AVENUE between 15th Street and Palmer Street, as shown on Sheets Nos. 19, 30 and 45 of said plans. EIGHTEENTH: The grading and appurtenant work; In that portion of SPARKES STREET 1 extending 100 feet Southeasterly from the centerline of Orange Avenue, as shown on +■ Sheet No. 5 of said plans. NINETEENTH: The grading, paving with plant mixed surfacing material over rock base and seal coat, construction of cement concrete combination curbs and gutters, cement concrete cross gutter, removing obstructions, including existing pavement, plant mixed berm, curb and gutter, and appurtenant work in connection therewith; In that portion of ROCHESTER STREET extending 45 feet Northwesterly from the centerline of Orange Avenue, as shown on Sheet No. 6 of said plans. TWENTIETH: The grading, paving with plant mixed surfacing material over rock base and seal coat, construction of cement concrete combination curbs and gutters, regoving obstructions, including existing pavement, and appurtenant work in connection therewith; In that portion of ROGERS PLACE extending 45 feet Southwesterly from the centerline of 18th Street, as shown on Sheet No. 30 of said plans. There is specifically excepted from any and all of the above described items of improvement any portion of the said work already constructed and existing to line and grade within the streets hereinabove described. PLANS, PROFILES, DRAWINGS AND SPECIFICATIONS SECTION 2. All of the said work and improvement to be done, shall be constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, profiles and drawings for the construction of said improvements in East 17th Street and certain other streets and alleys, being Plan No. 7, consisting of 51 sheets, on file in the office of the City Engineer of said City, and except as otherwise provided on said plans in further accordance with the Specifications for the construction of said improvements, said Specifications being on file in the office of the City Clerk of said City, and to Which plans, profiles, drawings and Specifications heretofore approved by the City Council of said City, reference is hereby made for a further, full and more particular des- cription of said work, and by reference thereto the same are incorporated herein and made a part hereof. DESCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the said contemplated work and improvement, in the opinion of the said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the said work and improvement chargeable upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, and which district is described as follows: 656. All that certain territory or the City of Costa Mesa, California, exclusive of streets and alleys, included within the exterior boundary line shown upon that certain 9 Plat, Ebibit "A", consisting of 12 pages, attached to and forming a part of the In- vestigation Report prepared and filed under the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," Division L of said Streets and Highways Code, heretofore approved by the City Council of said City on the lith day of November, 1957, indicating by said boundary line the extent of the territory included within the proposed assessment district, and which map or plat is on file in the office of the City Clerk of said City. Reference is hereby made to said map or plat for a further, full and more particular description of the said assessment district, and the said map or plat so on file shall govern for all details as to the extent of the said assessment district. DESCRIPTION OF BONDS SECTION L. That serial bonds bearing interest at the rate of six percent (6%) per annum shall be issued to represent each assessment of Fifty Dollars ($50.00) or more, remaining unpaid for thirty (30) days after the date of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October f . fteenth following their date. Payments on the principal of unpaid assessments and interest thereon shall be made by property J owners to the City Treasurer, and the same shall be disbursed by said City Treasurer, all as provided in the "Improvement Act of 1911," hereinafter referred to. The redemption provisions of said bonds shall require the payment of a premium of 5 percent of the unpaid principal, and the wads "together with a premium of 5 percent of said unpaid principal" shall be added after the redemption clause in the bond form of the bonds issued. NOTLCE IS HEREBY GIVEN that on the 17th day of March, 1958, at the hour of seven -thirty (7:30) o'clock P.M., in the Council Chamber of the City Council, in the Costa Mesa City Hall, located at 695 West 19th Street, in said City of Costa Mesa, any and all persons having any objections to the proposed work or improve- ment, or to the extent of the assessment district, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this Resolution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IMPROVEMENT ACT Gb7, SECTION 6. That all of the work herein proposed shall be done and carried through in pursuance of an Act of the Legislature of the State of Calif- ornia, designated the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION OF INTENTION SECTION 7. The Costa Mesa Globe -Herald, a tri -weekly newspaper, printed, published and of general circulation in the City of Costa Mesa, California, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the proceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adoption of this Res- olution of Intention to all persons owning real property proposed to be assessed whose names and addresses appear on the last equalized assessment roll for City Taxes, all in the manner and form provided for under Sections 5070, 5194 and 5195 of the said "Improvement Act of 1911" of said Streets and Highways Code, cause to be conspicuously posted along the line of said contemplated work or improve- ment and along all open streets within the district liable to be assessed for said work, notices of passage of this Resolution of Intention, in the time, form and manner provided by said Code. INVESTIGATION REPORT SECTION 9. That the written report of the Assessment Engineer on the proposed improvements herein described and prepared pursuant to the provisions of the "Special Assessment, Investigation, Limitation and Majority Protest Act of 19311" being Division 4 of the Streets and Highways Code of the State of California, is on file in the office of the City Clark of said City and Is open to public inspection. ESTIMATE OF THE TOTAL COST OF THE PROPOSED WORE SECTION 10. The estimated total cost of the proposed work is $640,306.28. PASSED AND ADOPTED by the City Council of the City of Costa Mesa, Calif- ornia, at a regular meeting, thereof, held on the 17th day of February, 1958, by the following roll call vote, to -wit - AYES: COUNCILMEN J.
