HomeMy WebLinkAbout454 - 17th Street Improvement District - Rate of WagesG'79 RESOLUTION NO. 454 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ASCERTAINING AND DETERMINING THE PREVAILING RATE OF WAGES TO BE PAID FOR THE FOLLOWING FUBLIC IMPROVEMENT IN THE CITY OF COSTA MESA: IN EAST 17TH STREET AND CERTAIN OTHER STREETS AND ALLEYS. WHEREAS, the City Council of the City of Costa Mesa did, on the 17th day of February, 1958, adopt Resolution of Intention No. 441 for the grading, paving, construction of curbs and gutters, concrete cross gutters, sanitary sewers, house connection sewers, manholes, water house connections, installation of water mains and replacement of existing water mains, installation of certain pipe, structures and appurtenances for drainage purposes, relocation of fire hydrants, removal of certain obstructions, together with appurtenances and appurtenant work in conn- ection therewith, in East 17th Street and certain other streets and alleys in said City; and WHEREAS, pursuant to the provisions of Section 1773 of the Labor Code of the State of California, it is necessary that the City Council of the City of Costa Mesa ascertain and determine the general prevailing rate of per diem wages in the public improvement, to ascertain and determine the general prevailing rate of per, diem wages in the locality in which the public work is to be perfomred for each craft, classification or kind of workman or mechanic needed to execute the contract, and also the general prevailing rate for holiday and overtime work in the locality for each craft, classification or type of workman or mechanic in accordance with the schedule attached hereto; and WHEREAS, said Section 1773 of the Labor Code of the State of California requires the awarding body, in determining such rates, to ascertain and consider the applicable wage rates established by collective bargaining agreements and such rates as may have been predetermined by Federal public work within the locality and in the nearest labor market area and where such rates do not constitute the rates actually prevailing in the locality that the awarding body shall obtain and consider further data from labor organizations, employers or employer associations concerned, including the recognized collective bargaining representatives for the particular craft, classification or type of work involved. NOW, THEREFORE, the City Council of the City of Costa Mesa has ascertained and does hereby determ'ne that the general prevailing rate of per diem wages in the locality, and the provisions of tFe said Code make it mandatory upon the awarding body of any public contract where said body substantially calls for any bids for any public improvement, to ascertain and determine the general prevailing rate of per, diem wages in the locality in which the public work is to be perfomred for each craft, classification or kind of workman or mechanic needed to execute the contract, and also the general prevailing rate for holiday and overtime work in the locality for each craft, classification or type of workman or mechanic in accordance with the schedule attached hereto; and WHEREAS, said Section 1773 of the Labor Code of the State of California requires the awarding body, in determining such rates, to ascertain and consider the applicable wage rates established by collective bargaining agreements and such rates as may have been predetermined by Federal public work within the locality and in the nearest labor market area and where such rates do not constitute the rates actually prevailing in the locality that the awarding body shall obtain and consider further data from labor organizations, employers or employer associations concerned, including the recognized collective bargaining representatives for the particular craft, classification or type of work involved.
