HomeMy WebLinkAbout482 - 17th Street Improvement District - Making Changes733 RESOLUTION No. 482 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DETERMINING RESULTS OF HEARING ON RESOLUTION OF INTENTION TO MAKE CHANGES IN THE WORK PROPOSED TO BE DONE, OVERRULING PROTESTS, AND DETERMINING THAT THE PUB- LIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE CERTAIN CHANGES IN THE WORK PROPOSED TO BE DONE IN THE IMPROVE- MENT OF EAST 17TH STREET AND CERTAIN OTHER STREETS AND ALLEYS (ASSESSMENT DISTRICT NO. 6) WHEREAS, the City Council of the City of Costa Mesa did on the 12th day of May, 1958, adopt Resolution No. 477 declaring its intention to make changes in the work proposed to be done in the improvement of East 17th Street and certain other streets and alleys, to wit: A. The grading, paving with plant mixed surfacing material over rock base and seal coat, construction of cement concrete cross gutter, and removing obstructions, including existing pavement and appurtenant work in connection therewith; In that portion of WESTMINSTER AVENUE as shown on Sheet No. 30 of Plan No. 7 for the Improvement of East 17th Street and Certain Other Streets and Alleys, consisting of 51 sheets, to which said plans and specifications, on file in the Office of the City Clerk, are hereby referred to, and which shall govern for all details of said work. B. The installation of fire hydrants; In SANTA ANA AVENUE 16TH PLACE OGLE STREET provement of East 17th Street and Certain Other Streets and Alleys, consist- ing of 51 sheets, to which said plans and specifications, on file in the Office ■ of the City Clerk, are hereby referred to, and which shall govern for all details ` of said work. CABRILLO STREET as shown on Sheets Nos. 31, 34, 37, 38, 4o and 42 of Plan No. 7 for the Im- provement of East 17th Street and Certain Other Streets and Alleys, consist- ing of 51 sheets, to which said plans and specifications, on file in the Office ■ of the City Clerk, are hereby referred to, and which shall govern for all details ` of said work. 734 C. The construction of cement concrete alley apron; In THAT CERTAIN ALLEY OFF OGLE STREET BETWEEN ORANGE AVENUE AND WESTMINSTER AVENUE as shown on Sheet No. 36 of Plan No. 7 for the Improvement of East 17th Street and Certain Other Streets and Alleys, consisting of 51 sheets, to which said plans and specifications, on file in the Office of the City Clerk, are hereby referred to, and which shall govern for all details of said work. D. The extension of pavement and cross gutters; In CABRILLO STREET, TO CONNECT WITH THE EXISTING IMPROV3,=S ON NEWPORT BOULEVARD as shown on Sheet No. 42 of Plan No. 7 for the Improvement of East 17th Street and Certain Other Streets and Alleys, consisting of 51 sheets, to which said plans and specifications, on file in the Office of the City Clerk, are hereby referred to, and which shall govern for all details of said work. E. The elimination and deletion of the removal of existing 18" concrete pipe storm drain over and across Lot No. 6, and the capping of said concrete pipe at both ends thereof at the property line, which said elimina- tion of work and change in work is shown on Sheet No. 47 of Plan No. 7 for the Improvement of East 17th Street and Certain Other Streets and Alleys, con- sisting of 51 sheets, to which said plans and specifications, on file in the Office of the City Clerk, are hereby referred to, and which shall govern for all details of said work, and WHEREAS, said Resolution No. 477 was published as required by law; and WHEREAS, said Resolution No. 477 fixed the time and place for hear- ing of objections to the proposed change for the 2nd day of June, 1958; and WHEREAS, the time and place so fixed for hearing was held by the said City Council at which hearing all written protests or objections were presented, read, and all persons desiring to be heard thereon were heard, and no person having filed any written protests or objections, no person desiring to be heard, the City Council having given all persons present an opportunity to be heard, NOW, THEREFORE, the City Council of the City of Costa Mesa, Cali- fornia, does hereby resolve, determine, and order as follows: 735 SECTION 1. That Resolution No. 477, adopted on the 12th day of May, 1958, has been duly and regularly published as required by law. SECTION 2. That no written protests or objections to the proposed changes has been filed with the Clerk of the City Council. SECTION 3• That the public interest, convenience, and necessity require that the proposed changes be made and ordered. SECTION 4. That this City Council does hereby determine and or- der that the following changes be made in the work proposed to be done, to wit: A. The grading, paving with plant mixed surfacing material over rock base and seal coat, construction of cement concrete cross gutter, and removing obstructions, including existing pavement and appurtenant work in connection therewith; In that portion of WESTMINSTER AVENUE as shown on Sheet No. 30 of Plan No. 7 for the Improvement of East 17th Street and Certain Other Streets and Alleys, consisting of 51 sheets, to which said plans and specifications, on file in the Office of the City Clerk, are hereby r referred to, and which shall govern for all details of said work. The extension of pavement and cross gutters; In CABRILIA STREET, TO CONNECT WITH THE EXISTING INNd'ROVENfENTS ON NEWPORT BOULEVARD as shown on Sheet No. 42 of Plan No. 7 for the Improvement of East 17th Street and Certain Other Streets and Alleys, consisting of 51 sheets, to which said plans and specifications, on Pile in the Office of the City Clerk, are hereby referred to, and which shall govern for all details of said work. E. The elimination and deletion of the removal of existing 18" concrete pipe storm drain over and across Lot No. 6, and the capping of said concrete pipe at both ends thereof at the property line, which said elimination of work and change in work is shown on Sheet No. 47 of Plan No. 7 for the Improve- ment of East 17th Street and Certain Other Streets and Alleys, consisting of 51 sheets, to which said plans and specifications, on file in the Office of the City Clerk, are hereby referred to, and which shall govern for all details of said work. SECTION 5• That the City Council has determined from the En- gineer's estimate that the aforesaid changes in the work proposed to be done does not increase the estimated cost by more than ten per cent (lO%); that the amount of the estimated increase and/or decrease in the cost of the work by reason of said changes is none. SECTION 6. That by this Resolution it is the intention of this City Council to order the aforesaid changes of work by the affirmative four- fifths vote (4/5) of all members present thereof.
