RESOLUTION NO. h76
A RESOLUTION OF THE. CITY COUNCIL OF THE CITY OF COSTA MESA
OF INTENTION TO ANNEX, AND GIVING NOTICE THEREOF.
WHEREAS, there is situated outside of and contiguous to the City of Costa
Mesa a certain uninhabited area as hereinafter more particularly described; and
WHEREAS, the owners of over one-fourth of the land and the territory by area
and by assessed valuation as shown on the last equalized assessment roll of the
County of Orange have expressed themselves as desirous of having the same annexed
with the City of Costa Mesa; and
WHEREAS, it wc,ild be for the best interest of the City of Costa Mesa to
annex the said hereinafter described property; and
WHEREAS, there has been submitted, on or about the 28t1h day of April, 1958,
to the Orange County Boundary Commission a legal description and plat of the said
hereinafter described uninhabited area, for its approval, subject to Section 35002
of the Government Code of the State of California; and
WHEREAS, the approval of said Orange County Boundary Commission has been
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Costa Mesa,
a City of the Sixth Class, to annex the said real property as hereinafter described,
which said real property is contiguous to the present boundaries of said City of Costa
Mesa, and which property is, at the present time, uninhabited.
NOTICE IS HEREBY GIVEN, that it is proposed by the said City of Costa Mesa to
annex the hereinafter described real property to the City of Costa Mesa, which said
real property shall, in these proceedings, be ]mown as Annexation No. 23* to the said
City of Costa Mesa, and bear the name 'UNDERWOOD ANNEXATION". The specific description
of the boundaries of the territory proposed to be annexed is as follows:
Beginning at a point in the existing boundary of the City
of Costa Mesa, said point being the most Southerly corner
of Lot 227, Newport Heights, as shown on a map thereof
recorded in Miscellaneous Maps Book h, pare 83, records of
L Orange County, California; thence from said point of begin-
ning Northwesterly along the Southwesterly line of said Lot
227 and the Northwesterly prolongation thereof to the North-
westerly line of Tustin Avenue; thence Northeasterly along
said Northwesterly line of Tustin Avenue to a line 110.00
feet Southwesterly of and parallel to the Northeasterly line
of said Lot 227; thence Southeasterly along said parallel
line to the Southeasterly line of said Lot 227; thence
Southwesterly along said Southeasterly line to the point
of beginning. .

FURTHER NOTICE IS HLREBY GIVEN, that on the 2nd day of June, 1058, at the
hour of 7:30 o'clock P.M., on said day, or as soon thereafter as the matter may be
heard, at the Council meeting in the City Hall of the City of Costa Mesa, 695 West
19th Street, Costa Mesa, California, a hearing will be had, at which hearing the City
Council shall hear and pass upon all written protests filed at any time before said
hour set for said hearing by any person owning real property within the territory so
proposed to be annexed, and at ary time before the hour set for said hearing any
owner of property within the territory proposed to be annexed may file a written
protest against the annexation. The protest shall set forth the name of the owner
of the property affected and give a description of the said property in general terms.
The City Clerk of the City of Costa Mesa is hereby authorized and directed
to cause a copy of this Resolution to be published once a week for two weeks prior
to said hearing in the COSTA MESA GLOBE -HERALD and PILOT, a newspaper of general
circulation printed and published in the City of Costa Mesa, in accordance with
Section 35311 of the Government Code of the State of California.

I, A. C. SWARTZ, City Clerk of the City of Costa Mesa, hereby certify
that the above and foregoing Resolution No. 476 was duly and regularly passed and
adopted by the City Council of the City of Costa Mesa at a regular meeting thereof
held on the 5th day of May, 1958.
