ITS INTENTION TO GIANT THE MIS FFANCIIISE APPLIES; FOE BY THE COSTA MESA
& S COMFANY UNDEF THE PROVISIONS OF CHAPTER 1, DTVISION 3, OF THE TUB -
LIC I TILITIES CODE OF TIMI SATE CF CALIFOENIA.
WHITEAS, the City Council has received from the Costa Mesa Bus Company,
a privately owned b"isiness, an application under and pursuant to Section 6004 of
the R:blic Utilities Code, which said application states that the purpose for which
the franchise therein applies for is desired is to use the streets and alleys in
the Cit, of Costa Mesa for a bus route within the Cite of Costa Mesa, and that the
term for which the franchise therein applied for is for a period of ten (10) years;
ANL, WHEFEAS, said application frrther states that the applicant, if
granted the franchise therein applied for, will pay to the City of Costa Mesa,
durinr the life of the franchise, two (25) percent of the gross annual receipts
of applicant, arising fTr� the use, operati.cn, or possession of the franchise.
NOL, THEIEFOEE, BE IT FESOLVLD that this Cit,,, Council, under and pursuant
to the provisions of Chapter 1, Division 3 of the Public Utilities Code, does hereby
declare its intention to grant to Costa Mesa Bos Company the franchise so applied
for, that sealed bids for such franchise will be received up to the hour of 7:30
P.N., Monday, April 41 1055; all such bids shall be accompanied with cash or cert-
ified check, payable to the Treasurer of the C ty of Costa Mesa, for the full am-
ount of the bid. Said bids shall contain a statement that the bidder shall, during
the life of the franchise, pay the City of Costa Mesa two (2%) percent of the gross
annual receipts arising from the use, operation or possession of the franchise;
that Monday, the 4th day of April, 1055, at 7:30 P.'"., at the place where the City
Council usuallc meets, to -wit; 567 West 18th Stieet, -osta ;less, CalSfornia, is
hereb- fixed as the day, hour and place that the franchise will be struck off, sold
and awarded to the poison, firm or corporation makins the highest cash bid therefor;
and that at the tine of the opening of the tills, anv respo-sable person, firm or
corporation present or represented may bid for the franchise a sum not less than
ten (10`) percent above the highest sealed bid therefor.
BE IT FUFTHEF FESOLVED that the successful birder shall be req,ired to
file a bond running to the City of Costa Mesa with at least two good and acceptable
sureties to be approved by the City Council and to the penal sum hereby prescribed
to be One Thousand (w1,000.00) Dollars, and conditioned that such successful bidder
shall well and truly observe, fulfill andperform each term and condition of the
franchise and that in case of any breach of the condition of the bond, the whole

amount of the penal sum herein named shall be deemed to be liquidated damages and
shall be recoverable from the principal sureties upon the bond.
