HomeMy WebLinkAbout126 - River Annexation - Intention to Annex193 FESOLUTION NO. 126 A FESOLUTION OF THE CITY COUNCIL OF TFL CITY OF COSTA MESA OF INTENT- ION TO ANNEX, AND GIVTNG NOTICE THEFEOF. WuERIAS, there is situated outside and contiguous to the City of Costa Mesa a certain uninhabited area as hereinafter more particularly described; and 1nTiEFEAS, the owners of over one-half of the land and the territory by area and by assessed valuation as shown on the last equalized assessment roll in the County of Oran..^e have expressed themselves as desirous of having the same annexed with the City of Costa Mesa, and WHEFEAS, it world be for the best interests of the City of Costa Mesa to annex the said hereinafter described prcpeity, and WHEFEAS, there has been submitted on or about the 16th day of May, 1955, to the Orange County Boundary Commission a legal description and plat of the said hereinafter uninhabited area, for its approval, pursuant to Section 35002 of the Government Code of the State of California; and VUEAS, the approval of said Orange County Boundary Commission has been secured and reported upon by the Boundary Commission with respect to the definite- Mesa, a City of the Sixth Class, to annex the said real property as hereinafter descr bed, which said real property is contiguous to the present boundaries of said City of Costa Mesa, and whir property is, at the present time, uninhabited. NGTTC'E IS HEFLRf GTVEN that it is pronosed be the said City of Costa Mesa to annex the hereinafter described real property to the City of Costa Mesa, which said real property shall, in these proceedings, bear the name "Fiver Annexation". The specific description of the boundaries of the territory proposed to be annexed are as follows: Beginning at a point in the westerly boundary line of the City of Costa Mesa, said point bei.nr the intersection of the southerly prolongation of the centerline of Valley Foad as said Valley Foad is laid out and shown on a map of Tract No. 653, recorded in Miscellaneous Maps, Book 19, Page 42, Fecorcs of Orange Coanty, California, with the westerly pro- longation of the northerly line acq,ired by the City of Newport Beach by condemnation, recorded January 27, 1053, in Book 240, Page 80 of Off- icial Fecords of said Oranre County; thence easterly alone said westerly prolongation to the northwesterly corner of said land acq.. ired by the City of Newport Beach; thence sout"erly along the westerly line of said land acq iied by the City of Neumort Beach to the westerly prolongation of the centerline of loth Street as loth Street is laid out and shown on a map of Newport Mesa Tract, recorded in Miscellaneous Maps Book 5, Page 1, recor<s of said Oranre County; thence westerly along sw d westerly pro- longation of the centerline of loth Street to the west line of the Joint Outfall Sewer right of way as descr bed in Book 538, Page 47, Official ness and the certainty of the proposed boundaries; L NOW, THE]EFOFE, BE IT FESOLVED, by the City Council of the City of Costa Mesa, a City of the Sixth Class, to annex the said real property as hereinafter descr bed, which said real property is contiguous to the present boundaries of said City of Costa Mesa, and whir property is, at the present time, uninhabited. FL'FTHEP NOTICE IS HEREBY GIVEN, that on June 20th, 1055, at the hour of 7:30 Y.M. on said day, or as soon thereafter as the matter may be heard, at the Council meeting at the Justice Court of Newport Beach Judicial District, 567 West Eighteenth Street, Costa Mesa, California, a hears ng will be had, at which he^ring the City Council shall hear and pass upon all written protests filed at any time before said hour set for said hearing by any person owning real property within the territory so proposed to be annexed, and at any time before the horr set for said hearing any owner of property within the territory proposed to be annexed may file a written protest aga4nst the annexation. The protest shall set foith the name of the owner of the property affected and give a description of said property in general terms. The City Clerk of the Cit? of Costa Mesa is hereby authorized and direct- ed to cause a copy of this Resolution to be published once a week for two weeks prior to said hearing in the Costa Mesa Globe -Herald, a newspaper of general publication, published in the City of Costa Mesa, and also in the Santa Ana Reg- ister, a newspaper of General circulation published in the County of Orange and outside the City of Costa Mesa. The Cit? Clerk is further authorized and directed to mail a written not- ice of the -i Hosed annexation to all persons to whom land proposed to be annex- ed is assessed in the last availatle egcalized assessment roll at the address sown thereon or as known to said City Clerk. Fesolution Ne. 123 is hereby repealed.
