A RESOLUTION OF TO CITr OOWOIL OF THE CITr OF COSTA MESA
On motion of Councilman Smith, daly seconded and carried, the following
Resolution was adopteds
WELT=, by Ordinance No. 88 of the City of Costa Mesa, adopted May 29
1955, this Council declared its intention to order the laying out and opening
of public streets in the incorporated territory of Costa Mew, Orange County,
California, extending form Orange Avenue to Santa Ana Avenue, and designated
as Virginia Place, Cecil Place and Albert Place, over and across the strip of land
described in said Ordinance No. 88= and
WHEREAS, said matter ease on regularly for hearing before this Council
on dune 6, 1955, the date fixed for the bearing of protests.
WHEREAS, one mitten protest to the proposed improvement or to the
extent of the assessment district having been filed with this Council and this
Council having heard and overruled all oral and written proteetsl
NOP, THEREFORE, BE IT RESOLVED that this Council hereby finds that the
public interest and convenience require the laying out and opening of public
streets in the incorporated territory of Costa Mew, Orange County, California,
extending from Orange Avenne to Santa Ana Avenue, over and across the strip of
land described in Ordinance No. 88 of the County of Orange, adopted Mey 29 19559
and in the amuner contemplated by said Ordinance We. 88, to which Ordinance
reference is hereby made for all particulars regarding said improvements.
BE IT FCRTRER RESOLVED that the City Attorney of the City of Costa Mew
be and is hereby authorized, empowered and directed to bring an action or actions
in the nese of the City of Costa Mew, in the Superior Court of the State of
California in and for the County of orange, for the condemnation of the real
properties described in Ordinance No. 88 hereinbefore referred to, necessary and
eonwenient to be taken for the improvement described therein and in this Resolution,
against all the owners and claimants of mid properties or any part thereof.
