HomeMy WebLinkAbout65-53 - Paularino No. 8 Annexation - Intent to AnnexRESOLUTION N0. 65-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA OF INTENTION TO ANNEX TO SAID CITY A CERTAIN UNINHABITED AREA DESIGNATED AS "PAULARINO NO. 8 ANNEXATION" AND NOTICE OF THE PROPOSED ANNEXATION OF TERRITORY TO THE COSTA MESA RECREATION AND PARK DISTRICT IN ORANGE COUNTY. WHEREAS, there is situated outside of and contiguous to the City of Costa Mesa a certain uninhabited area as hereinafter more particularly described; and WHEREAS, it would be for the best interest of the City of Costa Mesa to annex the said hereinafter described property; and the City Council does therefore initiate this annexation; and WHEREAS, the area above referred to is also outside of and contiguous to the Costa Mesa Recreation and Park District; and WHEREAS, the City Council of the City of Costa Mesa, as supervising authority of said District, finds and determines that said territory should be annexed to the existing Costa Mesa Recreation and Park District; and WHEREAS, the report of the Orange County Boundary Commission has been secured and reported upon by said Boundary Commission with respect to the difiniteness and certainty of the proposed boundaries; and WHEREAS, said proposed annexation has been submitted to the Local Agency Formation Commission of Orange County for review, and said Commission has found and determined its approval thereof; NOW, BEFORE, BE IT RESOLVED, by the City Council of the City of Costa Mesa, to annex to the City of Costa Mesa the said real property as hereinafter described, which said real property is contiguous to the present boundaries of the City of Costa Mesa and which property is at the present time uninhabited; and THEREFORE, BE IT RESOLVED FURTHER, by the City Council of the City of Costa Mesa, as the supervising authority of the Costa Mesa Recreation and Park District, to annex to the existing Costa Mesa Recreation and Park District, the said real property as hereinafter described, which said real property is contiguous to the existing Costa Mesa Recreation and Park District. NOTICE IS HEREBY GIVEN that it is proposed by the City of Costa Mesa to annex to said City the herein described real property and to the Costa Mesa Recreation and Park District, which said real property shall in these proceedings be known as "PAULARINO NO. 8 ANNEXATION" to the City of Costa Mesa and the Costa Mesa Recreation and Park District. The Specific description of the boundaries of the territory proposed to be annexed to the City of Costa Mesa and the Costa Mesa Recreation and Park District is as follows: A parcel of land lying within Lots 5 and 6, Block E of the Berry Tract, in the County of Orange, State of California, as shown on a map thereof, recorded in Book 30, page T4 of Miscellaneous Records of Los Angeles County, California, more particularly described as follows: Beginning at an angle point in the existing boundary of the City of Costa Mesa as said boundary is described in Paularino No. 5 Annexation to the City of Costa Mesa, California, Ordinance No. 62-5, adopted March 19, 1962, said angle point being the intersection of the southerly pro- longation of the westerly line of Lot 5, Block D, Berry Tract as shown on a map thereof, recorded in Book 9, page 6 of Miscellaneous Records of Los Angeles County, California, with the southerly line of Paularino Avenue, 66 feet in width, as shown on a map of Tract No. 4894, recorded in Book 172, pages 30 and 31 of Miscellaneous Maps, Records of Orange County, California; thence South 890 49' 35" East, along said southerly line of Paularino Avenue and said existing boundary and the existing boundary as described in Paularino No. 1 Annexation to the City of Costa Mesa, California, Ordinance No. 283, adopted January Il, 1960, a distance of 1052.25 feet to a line parallel with and 3.80 feet westerly of the west line of Lot 4, Block E of said Berry Tract; thence, departing from said southerly line of Paularino Avenue South 00 11' 45" West, along said parallel line and the existing boundary as described in Bristol No. 1 annexation to the City of Costa Mesa, Ordinance No. 144, adopted October 22, 1956, a distance of 382.50 feet, more or less, to a line parallel with and 372.5 feet northerly of the north line of Baker Street, 80 feet in width, (formerly an unnamed street, 66 feet in width) as shown on a map of said Block E, Berry Tract; thence North 890 48' 15" West along said parallel line and the existing boundary as described in Morales Annexa- tion to the City of Costa Mesa, Ordinance No. 360, adopted June 5, 1961 and Baker No. 6 Annexation to the City of Costa Mesa, Ordinance No. 64-34, adopted August 3, 1964, a distance of 313.0 feet to a line parallel with and 211.2 feet easterly of the westerly line of said Lot 5, Berry Tract; thence South 00 ll' 45" West along said parallel line, 372.5 feet to the north line of previously mentioned Baker Street; thence North 890 48' 15" West, along said north line of Baker Street and the existing boundary of the City of Costa Mesa as described in said Bristol No. 1 Annexation, 739.22 feet to the westerly line of Lot 6, Block E of said Berry Tract; thence North 00 11' 45" East, along said westerly line of Lot 6, 458.00 feet to a line 330.00 feet southerly of and parallel with the center line of previously mentioned Paularino Avenue; thence departing from said existing boundary North 00 11' 45" East along said westerly line of Lot 6, Berry Tract, 297.00 feet to the point of beginning. FURTER NOTICE IS HEREBY GIVEN, that on the 2nd day of August, 1965, at the hour of 7:30 o'clock p.m., or as soon thereafter as it may be heard, in the Council Chamber at the City Hall in the City of Costa Mesa, 695 west 19th Street, Costa Mesa, California, hearings will be held at which hearings the City Council shall hear and pass upon all written protests to the annexation to the City filed at any time before said hour set for said hearings, by any person owning real property within the territory so proposed to be annexed to said City and at any time before the said hour set for said hearings any owner of the property within the territory proposed to be annexed may file a written protest against the annexation to said City. The protest shall set forth the name of the owner of the property affected and give a description of the pro- perty in general terms. NOTICE IS HEREBY FURTHER GIVEN that unless more than one (1) percent of the total number of voters living within the territory proposed to be annexed to the Costa Mesa Recreation and Park District have, at or prior to said hearing, filed written objections to said annexation, the question of annexation shall not be submitted to the voters at an election. At the time and place fixed for said hearing the City Council shall hear any person objecting to said annexation. The City Clerk of the City of Costa Mesa is hereby directed and authorized to cause a copy of this Resolution and Notice to be published once a week for two successive weeks prior to said hearing in the ORANGE COAST DAILY PILOT, a newspaper of general circulation printed and published in the City of Costa Mesa, and in the SANTA ANA REGISTER, a newspaper of general circulation printed and published in the County of Orange outside the City of Costa Mesa. ADOPTED: ,Tune 21, 1965 RESCINDED and replaced by Resolution No. 65-64, adopted July 19, 1965.
