HomeMy WebLinkAbout67-24 - River No. 5 Annexation - Application to LAFC+'VY RESOLUTION N0. 67-24 RESOLUTION OF APPLICATION BY THE CITY OF COSTA MESA, ORANGE COUNTY, CALIFORNIA, TO THE LOCAL AGENCY FORMA- TION COM41SSION FOR THE ANNEXATION OF TERRITORY. THE CITY COUNCIL OF THE CITY OF COSTA MESA, ORANGE COUNTY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: (a) That the Local Agency Formation Commission did on the 27th day of February, 1967, present the legal description of the proposed annexation River No. 5 to the County Surveyor for checking and the same having been found reasonably definite and certain; and (b) That the City Council of the City of Costa Mesa does hereby find and determine: 1. That the property proposed to be annexed to the City of Costa Mesa is uninhabited, is contiguous to the boundaries of the City of Costa Mesa. 2. That the territory to be annexed is designated as River No. 5 and the legal description of the property is as follows: "A parcel of land lying within a portion of Sections 28, 32 and 33, Township 5 South, Range 10 West, and in a portion of Section 5, Township 6 South, Range 10 West in the County of Orange, State of California, more particularly described as follows: Beginning at an angle point in the existing boundary of the City of Costa Mesa as said boundary is described in the Talbert No. 1 Annexation to said City, Ordinance No. 151, adopted January 7, 1967, said angle point being the intersec- tion of the Northerly line of Talbert Avenue, 60 feet in width, as shown on a map of Tract No. 1083, recorded in book 35, page 8 of Miscellaneous Maps, records of Orange County, California with the Northerly prolongation of the Easterly line of the Santa Ana River, said easterly line being the Easterly line of that 25 foot strip of land conveyed to the Orange County Flood Control District by deed, recorded August 21, 1948 in book 1690, page 408 of Official Records; thence South 290 04' 00" West along said existing boundary, said north- erly prolongation and said Easterly line, 4701.84 feet to the beginning of a tangent curve, concave Southeasterly, having a radius of 22,743.30 feet; thence Southwesterly along said curve, through a central angle of 30 44' 37", an arc distance of 1486.01 feet to the Southerly line of Gisler Avenue, as described in a deed to the County of Orange, recorded in book 225, page 391 of Deeds, records of said Orange County, said Southerly line being on the existing boundary as described in the Mesa Verde No. 1 Annexation to said City, Ordinance No. 227, adopted April 20, 1959; thence South 890 46' 55" East, along said Southerly line and said existing boundary, 226.62 feet to a point on a non -tangent curve, concave Southeasterly, having a radius of 22,538.30 feet, a radial line through said point bears North 640 25' 57" West, said curve also being the Easterly line of the Greenville -Banning Channel as described in deeds to the Orange County Flood Control District, recorded in book 4645, page 179 and book 4367, page 346 of Official Records; thence Southwesterly along said curve, said existing boundary and the existing boundary as described in the Adams No. 3 Annexation to said City, Ordinance No. 390, adopted September 18, 1961, through a central angle of 120 09' 03" an arc distance of 4779.74 feet to a tangent line; thence South 130 25' 00" West, along said tangent line and said j j j existing boundary, 757.98 feet to a point on a line 50.00 feet Northerly, measured at right angles, and parallel with the center line of Adams Avenue as described in a deed to the County of Orange, recorded December 4, 1908 in book 160, page 180 of Deeds of said Orange County; thence South 890 29' 30" West along said parallel line and said existing boundary as described in Adams No. 4 Annexation to said City, Ordinance No. 62-7, adopted April 2, 1962, a distance of 236.96 feet to the Easterly line of the Santa Ana River, 300 feet in width, as described in a deed to the Newbert Protection District, recorded June 22, 1911 in Book 197, page 300 of Deeds, records of Orange County; thence departing from said existing boundary North 130 25' 00" East along said Easterly line, 815.01 feet to a tangent curve, concave Southeasterly, having a radius of 22,768.30 feet; thence Northeasterly along said curve through a central angle of 150 39' 00", an are distance of 6219.03 feet to a tangent line; thence North 290 04' 00" east, continuing along said Easterly line, 4688.13 feet to the Northerly line of said Talbert Avenue; thence South 890 40' 28" East along said Northerly line, 28.53 feet to the point of beginning. 3. That the reason for the proposed annexation is that the territory is ready for development and that City services are necessary for the protection of health, safety and welfare of the developers and that the City of Costa Mesa is the agency most feasible to provide said facilities to said area. That the County of Orange has requested the City of Costa Mesa to annex this property to conform the boundaries of the City with that of the Park and Recreation District. 4. That there are no special terms or conditions to the proposed annexation. 5. That the agencies effected by said annexation, to the best of applicant's knowledge, are as follows: County Sanitary District No. 7 Orange County Flood Control District Harbor District Mosquito Abatement District County Library District Metropolitan Water District Santa Ana School District 6. That attached hereto and made a part of this Resolution as Exhibit "A" is a map of the territory proposed to be annexed. 7. That all notices with respect to hearings should be mailed to the following persons: A. R. McKenzie, City Manager, City Hall, Costa Mesa Roy E. June, City Attorney, 1500 Adams Avenue, Suite 206, Costa Mesa Don Southworth, City of Costa Mesa Engineer, 116 East 18th Street, Costa Mesa PASSED AND ADOPTED this 6th day of March, 1967.
