HomeMy WebLinkAbout66-09 - Orange Coast College Improvement District - Engineer & AttorneyRESOLUTION No. 66-9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPOINTING ENGINEER AND ATTORNEY IN CONNECTION WITH ORANGE COAST COLLEGE IMPROVEMENT DISTRICT ASSESSMENT DISTRICT NO. 17; ESTABLISHING THE COMPENSATION FOR SAID ENGINEER AND ATTORNEY. The City Council of the City of Costa Mesa does hereby resolve and determine as follows: SECTION 1. D. Southworth be, and he is hereby appointed to act as Superintendent of Streets and/or Engineer of Work for the proposed improve- ment of Orange Coast College Improvement District in the City of Costa Mesa, to be had and taken under the provisions of the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California; and that the said D. Southworth is hereby authorized and directed to perform all duties imposed upon the Superintendent of Streets by Division 7, and all of the provisions of Division 7 applicable to the Superintendent of Streets shall apply to said person so appointed. SECTION 2. The compensation to be paid said Engineer is as follows: A. For construction plans, specifications and cost estimate, assess- ment diagram - six (6%) per cent of the cost of construction. B. For construction inspection and supervision, construction staking and final cost preparation -- four (4%) per cent of the cost of construction. C. For preparation of assessment, preparation of bonds and bond registration - three (3%) per cent of the cost of construction. SECTION 3• Donald Dungan, City Attorney of the City of Costa Mesa, and Roy E. dune, Assistant City Attorney of the City of Costa Mesa, are hereby appointed as the attorneys for Orange Coast College Improvement District, Assessment District No. 17, to conduct all the legal proceedings and prepare all the necessary legal documents in connection with said Orange Coast College Improvement District, Assessment District No. 17. SECTION 4. The compensation to be paid said attorneys for their services is as follows: A. For preparing petitions, resolutions, resolution of intention, notices, hearings and all other documents and legal work in connection with said Assessment District - three (3%) per cent of the cost of construction.
