A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, ORDERING THE WORK DESCRIBED IN RESOLUTION OF
INTENTION N0. 66-38 ADOPTED ON THE 2ND DAY OF MAY, 1966, IN
THE MATTER OF THE CONSTRUCTION OF IMPROVEMEN'T'S IN MERRIMAC
WAY AND CERTAIN OTHER STREE'T'S AND EASEMENTS.
WHEREAS, the City Council of the City of Costa Mesa, California, did,
on the 2nd day of May, 1966, pass and adopt its Resolution of Intention No.
66-38 for the proposed improvement of Merrimac Way and certain other streets
and easement (Assessment District No. 17), which Resolution of Intention was
duly and regularly published in the time, form and manner as required by
law, evidenced by Affidavit of Publication of said Resolution of Intention
on file in the Office of the City Clerk of said City of Costa Mesa; and
WHEREAS, after the adoption of said Resolution of Intention, notices
thereof entitled "Notice of Improvement" were duly and regularly posted;
and notices of the adoption thereof were duly and regularly mailed to all
persons owning real property proposed to be assessed for the improvement
described in said Resolution of Intention, as such owners appear on the last
equalized assessment roll for taxes prior to the date of mailing such notices,
or as known to the City Clerk; all of which said notices were posted and mailed
in the time, form and manner as required by law; and
WHEREAS, said City Council having duly received and considered the evi-
dence, both oral and documentary, concerning the jurisdictional facts per-
taining to this proceeding and concerning the necessity for the proposed
work and improvement and the benefits derived therefrom, and said City Council
of the City of Costa Mesa, California, having now acquired jurisdiction to
order the proposed work and improvement.
NOW, THE U70RE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
COSTA MESA as follows:
SECTION 1. That the public interest and convenience require the improve-
ment herein referred to, and said City Council hereby orders that the work
and improvements, as described in Resolution of Intention No. 66-38 passed and
adopted by the City Council on the 2nd day of May, 1966, and the plans, pro-
files and specifications therein referred to, be done and made.
SECTION 2. That the boundaries of the District to be assessed, and the
grades to which said work is to be done, shall be those described in Resolution
No. 66-38, and the plans, profiles and specifications therein referred to,
reference to which is hereby made for all particulars.
SECTION 3. That the work contemplated under Resolution of Intention No.
66-38 be, and the same is hereby, ordered to be done under the direction of
the City Engineer, and the materials used shall comply with the specifications
and be to the satisfaction of said City Engineer, instead of the Superintendent
of Streets, and directing that the contract to be entered into for said
improvement shall contain a provision to this effect.
SECTION 4. That the assessment to be made in said proceedings shall be
made and signed by the City Engineer, instead of the Superintendent of Streets,
and said City Engineer is so ordered and directed.

I, C. K. PRIEST, City Clerk and ex -officio Clerk of the City
Council of the City of Costa Mesa, do hereby certify that at a regular
meeting of the City Council of the City of Costa Mesa held on the 6th day of
June, 1966, the foregoing resolution, being Resolution No. 66-48, was
considered section by section, and that said Resolution was then passed
and adopted as a whole by the following roll cell vote, to wit:
AYES: Councilmen: Wilson, Tucker, Pinkley, Jordan
NOES: Councilmen: None
ABSENT: Councilmen: Barck
