A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, FINDING THAT THE TRIANGLE
SQUARE REDEVELOPMENT PROJECT COMPLIES WITH THE
PROVISIONS OF THE CITIZENS' SENSIBLE GROWTH AND
TRAFFIC CONTROL INITIATIVE (MEASURE G).
WHEREAS, the Citizens' Sensible Growth and Traffic Control Initiative
(Measure G) was approved by the voters in November 1988; and
WHEREAS, the purpose of Measure G was to enact a General Plan Amendment
and ordinances which will alleviate present and future traffic congestion
and to ensure an adequate quality of life for the future by establishing
Standard Levels of Service for the City's transportation and flood control
systems and for police or sheriff and fire and paramedic services; and
WHEREAS, the Standard Levels of Service established by Measure G are
not currently being met in certain areas of the community; and
WHEREAS, the provisions of Measure G allow projects to be approved
when the City's transportation and flood control systems and police or
sheriff and fire and paramedic services are operating at conditions worse
than the Adequate Levels of Service as long as the project's impact does
not cause the transportation system to operate at conditions worse than
existing and where a measurable improvement is achieved and the project's
impact does not cause police or sheriff, fire and paramedic or flood con-
trol systems to operate at conditions worse than the existing conditions;
and
WHEREAS, the Triangle Square redevelopment project consisting of
approximately 185,000 square feet of retail, entertainment, and restaurant
uses has been proposed to be developed on a 4.45 -acre site bounded by
Newport and Harbor Boulevards and 19th Street; and
WHEREAS, the impacts of the Triangle Square redevelopment project were
analyzed in terms of the provisions of Measure G as set forth in the Initial
Study for the project; and
WHEREAS, the analysis of the impacts of the Triangle Square redevelop-
ment project showed that the project does meet the provisions of Measure G
by not making existing transportation and flood control systems and police
or sheriff and fire and paramedic services operate at conditions worse than
existing and by providing a measurable improvement to existing transporta-
tion system conditions as set forth in the Initial Study for the project;
and
WHEREAS, the City Council of the City of Costa Mesa, California,
hereby finds and determines as follows;
A. The Triangle Square redevelopment project complies with Section
III.A.l.b. of Measure G in that the project's measurable traffic
does not cause the transportation system to operate at conditions
worse than existing and that a measurable improvement of 3.1
seconds can be achieved for northbound Newport Boulevard by adjust-
ing the signal timing along Newport Boulevard and by upgrading the
existing "split phase" signal operation at the Newport/Broadway
intersection as determined in a study prepared by Weston Pringle
and Associates, dated March 28, 1989. The analysis in the study
shows that all intersections to which the project contributes
measurable traffic currently operate at an acceptable level of
service (LAOS "D" or better) and will continue to operate at an
acceptable level of service upon project ccnpletion. The analysis
also shows that, with the exception of northbound Newport Boule-
vard, all links have, and are forecast to maintain, an acceptable
level of service (LOS "C" or better). The northbound Newport
Boulevard link currently operates at Los "D" and is forecast to
operate at LOS "D" with or without the project, but will be
improved as noted above.
B. The Triange Square redevelopment project complies with Section
III.B.l.b of Measure G, in that the project's impacts on police
services and fire/paramedic services will not cause these services
to operate at conditions worse than the existing conditions. The
analysis contained in the Initial Study shows that the project
will generate a number of calls for service that will cost the
City about $114,517.92 annually. Over the 40 -year projected life
of the buildings, this amounts to $4,580,716.80. Discounting
that figure to present value yields a result of approximately
$413,002.00 at a discount rate of 6.2%, which is the rate deter-
mined appropriate by the Financial Director. The development
agreement, to be assigned to the developer when it owns all the
land of the triangle block, requires the developer to comply with
Measure G by contributing $500,000 (less credit for certain
traffic improvements estimated to cost $25,000) to a fund for
expanding the resources of the Police and Fire Departments, to
offset the project's impact on polio and fire/paramedic services.
If additional funds are needed to maintain and improve service
levels, other financing mechanisms exist such as general and
special taxes, benefit assessment districts, Mello -Roos community
facilities districts, and developer fees programs that can be
applied to future projects.
Accordingly, the developer has agreed to contribute a sum up to
$500,000 (less the cost of required traffic circulation fees and
applicable improvements, other than those which are needed to
comply with the City's development standards) to a fund for expand-
ing the resources of the Police and Fire Departments to maintain
or improve existing service levels at the time of project comple-
tion.
C. The Triange Square redevelopment project further complies with
Sections III.B.l.b. and III.B.2. of Measure G in that the project
will not increase the amount of storm water runoff from the site
during a 100 -year storm as determined in a preliminary hydrology
study prepared by Hall and Foreman, Inc., dated February 10, 1989.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Costa Mesa, California, that the foregoing findings are true and correct
and hereby adopted.
