HomeMy WebLinkAbout89-152 - Ordering Vacations on 19th St. and Harbor and Newport Blvds.Recorded June 13, 1989 Document No. 89-309759 RESOLUTION NO. 89-152 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ORDERING THE VACATION OF PUBLIC STREETS IN THE AREA BORDERED BY HARBOR BOULEVARD, NEWPORT BOULEVARD, AND WEST 19TH STREET. WHEREAS, the City Council of the City of Costa Mesa did, on the 15th day of May, 1989, adopt Resolution No. 89-139, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECL.ARI.NG ITS INTENTION TO ORDER THE VACATION OF PUBLIC STREETS IN THE AREA BORDERED BY HARBOR BOULEVARD, NEWPORT BOULEVARD, AND WEST 19TH STREET"; WHEREAS, pursuant to said Resolution of Intention, the time and place for hearing all persons interested in or objecting to the proposed vacation was set for Monday, the 5th day of June, 1989, at the hour of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California; and WHEREAS, notices of said proposed vacation were duly and regularly posted as required by law, all pursuant to the provisions of Section 8300 et seq. of the Streets and Highways Code of the State of California; and WHEREAS, on said date of hearing the proixosed vacation came on regu- larly to be heard; all persons appearing on the proposes vacation were heard; and said hearing was closed on the 5th day of June, 1989; and WHEREAS, the City Council of the City of Costa Mesa finds and deter- mines from all the evidence submitted that the hereinafter described right- of-way is unnecessary for present or prospective street purposes; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOVro : 1. That the hereinafter described right-of-way is unnecessary for present or prospective street purposes. 2. It is hereby ordered that the following described right-of-way be, and the same is hereby vacated: PARCEL 1: The Easterly 10 feet of Lots 1, 2, 3, 4, 5, and 6 of Tract No. 428, as shown on a map thereof recorded in Book 17, Page 23 of Miscellaneous Maps, Records of Orange County, California; and the Westerly 10 feet of the Easterly 35.02 feet of Lot 20, Block A, of Tract No. 18, as shown on a map thereof recorded in Book 9, Page 20 of Miscellaneous Maps, Records of said Orange County. PARCEL 2: That certain Alley, 20 feet in width, of Block A, Tract No. 18, as shown on a map thereof recorded in Book 9, Page 20 of Miscel- laneous Maps, Records of said Oramje County, California, the North- westerly and Southeasterly lines of said Alley run parallel with the Northwesterly line of Newport Avenue, and lie within the Easterly line of Fairview Avenue (naw Harbor Boulevard) and the Southerly line of 19th Street. PARCEL 3: That portion of State road VII-Ora-43-01sa (Newport Avenue) relinquished to the City of Costa Mesa by the State of California, as described in Parcel 2 of a document thereof recorded in Book 2670, Pages 28 and 29, Official Records of said Orange Cbunty, California. Excepting therefrom all that road lying Southwesterly of Harbor Boule- vard and Northeasterly of 19th Street. ALSO RESERVING THEREFROM a public use easement for all existing under- ground and overhead public utilities, together with right of ingress and egress for the purpose of maintaining, replacing, and upgrading said existing public utilities. All as more particularly shown on a map attached hereto and by this reference made a part hereof. 3. This Resolution shall not become effective until a parcel map showing consolidation under common ownership of all land within the triangle block bounded by Newport Boulevard, Harbor Boule- vard, and 19th Street is approved by the Costa Mesa City Council and filed for recordation with the Office of the Orange County Recorder.
