HomeMy WebLinkAbout89-170 - Amending Retirement Plan for Safety EmployeesRESOLUTION NO. 89-170 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING THE RETIREMENT PLAN FOR SAFETY EMPLOYEES OF THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE, DETER- MINE, AND ORDER AS FOLLOWS: WHEREAS, the Retirement Plan for Safety Employees of the City of Costa Mesa, was established July 1, 1962, amended and restated in its entirety, effective July 1, 1984, is hereby amended as follows: SECTION 1.5 is hereby deleted and substituted language per Exhibit "A" attached. SECTION 2.1 is hereby amended to include the addition of a para- graph in Exhibit "A". NOW, THEREFORE, BE IT RESOLVED that the effective date of this amend- ment shall be August 7, 1989. BE IT FURTHER RESOLVED that nothing contained in this amendment to the restated Retirement Plan shall be held to alter or affect any of the provi- sions of this Plan other than as herein specifically provided. Cj4;2'&"j p - Y�k" CIny Clerk and ex -officio Clerk o the City Council of the City of Costa/". sa EXHIBIT "A" RESOLUTION NO. 89-170 AMENDMENT TO THE RETIREMENT PLAN FOR SAFETY EMPLOYEES OF THE CITY OF COSTA MESA The "Retirement Plan for Safety Employees of the City of Costa Mesa", which became effective July 1, 1962, and which was amended and restated in its entirety, effective January 1, 1984, is hereby amended, effective August 7, 1989, as follows: (1) By DELETING Section 1.5 and SUBSTITUTING therefor the following: 1.5 "Employee" means any person who is designated as a Police Officer or Fireman and who is regularly employed by the Employer on a full-time basis. A Person whose custcu ry employment by the Employer is for more than 20 hours in any one week or for more than five months in any one calendar year shall be deemed to be on a full-time basis. Persons who are employed or former employees who are rehired on a temporary, casual, or part-time basis shall not be included within the meaning of the word "Employee". No one workiaj on a contract basis shall be included within the meaning of the word "Enployee". (2) By ADDING a paragraph to the end of Section 2.1 (Eligibility Con- ditions), to read as follows: Notwithstanding anythiiYd foregoing to the contrary, no former Participant who is rehired by the Employer on a part-time basis shall be eligible to participate in the Plan. 1
