WHEREAS, a proposal for Santa Ana Avenue No. 3 Annexation to the City of Costa Mesa was approved on January 10, 1990, by the Local Agency Forma- tion Comission by Resolution No. 90-04, a copy of which is attached and made a part hereof; and WHEREAS, the City of Costa Mesa has been designated as the conducting authority and has been authorize,] to initiate annexation pr_ceedings with- out notice and hearing, or election, or both, in accordance with Section 56337 of the Goverrmtent Code of the State of California; NOW, THEREFORE, BE IT RESOLVED that this City Council hereby approves Santa Ana Avenue No. 3 Annexation to the City of Costa Mesa. Subject to the terms and conditions hereinafter 24 specified, said proposal is approved. z 25 Section 2. The boundaries of the territory proposed to be annexed 26 to the City of Costa Mesa are specifically described in the legal description attached hereto and by this 27 reference made a part hereof. Said territory is found to be uninhabited and is assigned the following short form designation: Santa Ana Avenue Annexation No. 3 to the City of Costa Mesa. Section 3. The City of Costa Mesa is designated as the conducting authority and the legislative body thereof is hereby directed to initiate annexation proceedings in compliance with this resolution. Section 4. The City of Costa Mesa is authorized to annex said territory without notice and hearing and without an election, pursuant to Section 56837 of the Government Code. Section 5. Kenneth and Margery Johnson, as applicants, shall be liable for and pay all proper expenses incurred in conducting proceedings in compliance with this resolution. Section 6. The Executive Officer is hereby authorized and directed to mail certified copies of this resolution in the manner as provided in Section 56853 of the Government Code. AYES: COMMISSIONERS DON R.
