HomeMy WebLinkAbout90-65 - Ballot Advisory Measure - Fireworks ProhibitedRESOLUTION NO. 90-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, SUBMITTING A PROPOSED ADVISORY MEASURE TO THE SUPERVISORS OF THE COUNTY OF ORANGE FOR THE BALLOT OF THE GENERAL MUNICIPAL ELECTION OF SAID CITY TO BE HELD ON NOVEMBER 6, 1990, WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON SAID DATE PURSUANT TO SECTION 23302 OF THE ELECTIONS CODE. WHEREAS, the City Council of the City of Costa Mesa called a General Municipal Election in said city to be held on November 6, 1990, for the purpose of the election of two (2) Members of the City Council of said City for the full term of four (4) years; and WHEREAS, the City Council of the City of Costa Mesa desires to submit to the voters of the City at the General Municipal Election a proposed advisory measure relating to the sale and discharge of fireworks within the City of Costa Mesa; and WHEREAS, the City Council is authorized and directed by statute to submit the proposed advisory measure to the voters; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALI- FORNIA, DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to general law cities, there is submitted to the Board of Supervisors of Orange County an advisory measure to be placed on the ballot of the General Municipal Election to be held on November 6, 1990, to read as follows: ADVISORY VOTE ONLY Should the City adopt such an ordinance to amend Article 8 of Title 9 of the Code to read as follows: ARTICLE 8. FIREWORKS PROHIBITED Sec. 9-177. Fireworks Prohibited. It is unlawful for any person to possess, store, to offer for sale, expose for sale, sell at retail or use or explode any fireworks; provided that the Fire YES Chief shall have the power to adopt reasonable rules and regulations for the granting of permits for super- vised public displays of fireworks by a jurisdiction, NO fair association, amusement parks, other organizations or for the use of fireworks by artisans in pursuit of their trade. Every such use or display shall be handled by a competent operator approved by the Fire Chief and shall be of such character and so located, discharged or fired so as, in the opinion of the Fire Chief after proper investigation, not to be hazardous to property or endanger any person. SECTION 2. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections; SECTION 3. That the City Clerk of the City of Costa Mesa is hereby directed to file a certified copy of this Resolution with the Board of Supervisors and the Registrar of Voters of the County of Orange.
