A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ADOPTING GENERAL PLAN
AMENDMENT GP -90-03 (ALTERNATIVE B-1), AMENDING
THE MASTER PLAN OF HIGHWAYS FOR THE BRISTOL
STREET/AN'I'ON BOULEVARD INTERSECTION.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, the General Plan, including a Transportation Element and
Master Plan of Highways, was adopted by the City Council of the City of
Costa Mesa by Resolution No. 81-67 on July 20, 1981; and
WHEREAS, the General Plan is a long-range, comprehensive document
which serves as a guide for the orderly development of Costa Mesa; and
WHEREAS, by its very nature, the General Plan needs to be updated and
refined to account for current and future community needs; and
WHEREAS, the City has conducted the North Costa Mesa Arterial Improve-
ments Study to identify arterial improvement projects necessary to provide
standard service levels to peak period traffic forecast through the year
2010; and
WHEREAS, an amendment to the City of Costa Mesa Master Plan of High-
ways is recommended to increase Master Plan designations at the Bristol
Street/Anton Boulevard intersection; and
WHEREAS, revised Addendum No. 3 to Program Environmental Impact Report
No. 1037 was completed to identify impacts and mitigation measures for the
arterial improvement project and Master Plan of Highways Amendment; and
WHEREAS, a Statement of Facts and Findings, a Statement of Overriding
Considerations, and Conditions of Approval/ Inventory of Mitigation Measures,
attached hereto as Attachments "A", "B", and "C", respectively, were pre-
pared pursuant to revised Addendum No. 3 to Environmental Impact Report No.
1037 and the requirements of the California Environmental Quality Act;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Costa Mesa does recognize the need to move toward standard service levels
on north Costa Mesa arterials and, as a result, adopts General Plan Amend-
ment GP -90-03 (Alternative B-1) to amend the Master Plan of Highways as
indicated in the attached Exhibit "A".
BE IT FURTHER RESOLVED that the attached Statement of Facts and Find-
ings (Attachment "A"), Statement of Overriding Considerations (Attachment
"B"), and Conditions of Approval/ Inventory of Mitigation Measures (Attach-
ment "C"), are hereby adopted.

STATEMENT OF FACTS
SIGNIFICANT ENVIRONMENTAL EFFECIS OF THE PROPOSED
PROJECT, FINDINGS WITH RESPECT TO SAID EFFECTS, AND
STATEMENT OF FACTS IN SUPPORT 'THEREOF, ALL WITH
RESPECT TO THE PROPOSED ALTERNATIVE B-1, PHASE 1"
PRELD61INARY ROADWAY DNPROVEMENT DESIGNS AT THE
BRISTOL STREET/ANION BOULEVARD INTERSECTION, PROJECT
AREA NO. 17, OF THE PREVIOUSLY ADOPTED NORTH COSTA
MESA SPECIFIC PLAN ARTERIAL IMPROVEMENT STUDY, AND
GENERAL PLAN AMENDMENT GP -90-03, IN THE CITY OF COSTA
MESA
State CEQA Guidelines (Guidelines) promulgated pursuant to the California
Environmental Quality Act (CEQA) provide in part:
"No public agency shall approve or carry out a project for which an EIR has
been completed which identifies one or more significant effects of the project
unless the public agency makes one or more written findings for each of those
significant effects, accompanied by a brief explanation of the rationale for
each finding."
The City of Costa Mesa proposes to approve construction of roadway improvements at
certain project areas in order to improve traffic levels of service through year 2010.
Pursuant to CEQA and the Guidelines, the City of Costa Mesa certified Program
Environmental Impact Report No. 1037 (SCH #87072917) on February 6,1989 (Resolution
No. 89-17), which addressed roadway improvements at 24 locations in North Costa Mesa,
and adopted General Plan Amendment GP -89-1B on February 21, 1989 (Resolution No.
89-18A). The Program EIR identified certain significant environmental effects which may
occur as a result of the project. The Final EIR included Addendum No. 1, which addressed
a minor modification to the Fairview Road/Baker Street intersection improvements. Prior
to certification of EIR No. 1037, in response to potential land use impacts, the City Council
directed staff to investigate additional roadway improvement alternatives at the Bristol

Street/Anton Boulevard intersection (Project Area No. 17) and the Fairview Road/Baker
Street intersection (Project Area No. 11, proposed for construction).
Pursuant to CEQA Guidelines Section 15164, the City prepared Addendum No. 3 to Final
EIR No. 1037 in order to address roadway improvement Alternative 'B-1, Phase 1" at the
Bristol Street/Anton Boulevard intersection. Implementation of Alternative T-1, Phase 1"
would have less environmental impact than the improvement design addressed in the Final
EIR (Alternative *A"). Additional alternatives were examined that might provide a slightly
better LOS, however, environmental impacts would be more significant than Alternative "B-
1, Phase 1'. Right-of-way acquisition, aesthetic impacts, and loss of parking spaces would

preliminary roadway improvement plans and to approve construction of Alternative 'B-1,
Phase 1" roadway improvements at the Bristol Street/Anton Boulevard intersection (Project
Area No. 17 of the previously adopted North Costa Mesa Specific Plan Arterial
Improvement Study) which would involve a substantial reduction of right-of-way acquisition,
thus avoiding significant land use impacts. In addition, the City proposes to adopt General
Plan Amendment GP -90-03 for the proposed roadway improvements in order to amend the
intersection leg designations on the City of Costa Mesa Master Plan of Highways.
However, impacts to an existing bus turnout and parking lot access may occur.
Based on the Addendum No. 3, to the Final EIR No. 1037, the City has prepared revised
findings, the revised Statement of Facts, the revised Statement of Overriding Considerations
and revised conditions of Approval/Inventory of Mitigation Measures as they relate to the
roadway improvement Alternative 'B-1, Phase 1" at Bristol Street/Anton Boulevard
intersection, the findings and statement of facts are set forth herein pursuant to Section
15091 of the CEQA Guidelines. Conditions of Approval, provided in Attachment "C", are
based on mitigation measures in Final EIR No. 1037, and Addendum No. 3. To ensure
compliance with the mitigation measures as required by Section 21081.6 of the Public
Resources Code, the Public Services Department shall be responsible for complying with
the mitigation measures in accordance with the City's adopted Mitigation Monitoring
Program. The Public Services Department shall manage this reporting and monitoring
program which shall consist of a written report outlining the method by which each
mitigation measure will be carried out, dates of completion and a list of individuals
responsible for monitoring the .project.
The following sections summarize Findings and Facts in support of findings for potential
environmental impacts associated with the minor technical changes or additions to the Final

EIR No. 1037 and discussed in Addendum No. 3 to Final EIR No. 1037. Except as
otherwise provided herein, the Findings, the Statement of Facts adopted by Resolution No.
89-18A are incorporated herein by this reference.
Implementation of the project will involve temporary construction activity effects such as
reduced access to some business uses and lane closures. However, mitigation measures will
reduce short-term impacts to insignificant levels. Implementation of the project will also
involve various long-term impacts due to right-of-way acquisition, including loss of frontage,
reduced access at commercial areas, and loss of landscaping. The revised project under
Alternative B-1, Phase 1" will substantially reduce these impacts.
(a) Changes have been required in, or incorporated into, the project which avoid
or substantially lessen the impacts on the environment as identified in the
Final EIR No. 1037 to a level of insignificance.
As detailed in Attachment "C" and in the Final EIR No. 1037 (pages 102-113, and
Responses to Comments) and Addendum No. 3, land use impacts will be mitigated
to less than significant levels. Short-term impacts will be mitigated by maintaining
access for commercial areas at all times (short-term impacts are also mitigated
through measures described in Circulation and Access, Climate and Air Quality,
Noise and Public Services and Utilities). Long-term impacts will be mitigated
through provision of compensation, as determined through a property appraisal and
fiscal assessment for each affected parcel, as appropriate.
To the extent the mitigation measures do not mitigate the land use impacts, specific
reasons support the decision for the project as contained in Attachment B".
All significant environmental effects that can feasibly be avoided have been
eliminated or substantially lessened by virtue of mitigation measures identified in
Attachment "A"

the Final EIR No. 1037, and Addendum No. 3 and incorporated into the project as
set forth above and in Attachment "C".
The project will result in temporary access restrictions during construction. However, with
required mitigation measures, this will be mitigated to less than significant levels. Long-
term effects will primarily be positive, as the project provides for improved traffic flow.
Prohibition of left turns into Scotts Restaurant and Westin Hotel from Anton Boulevard
will be necessary to improve traffic flow although alternative access to and from businesses
will be provided minimizing the impact of the access restriction. Parking areas will be
modified to provide additional landscaping and/or to improve circulation, although no net
loss of parking stalls would occur.
(a) Changes have been required in, or incorporated into, the project which avoid
or substantially lessen the impacts on the environment as identified in the
Final EIR No. 1037 to a level of insignificance.
Facts in Support of Finding
As detailed in Attachment "C" and in the Final EIR No. 1037 (pages 144-148 and
Responses to Comments) and Addendum No. 3, circulation and access impacts will
be mitigated to less than significant levels. The City will implement a Traffic
Control Program to mitigate temporary impacts. Access will be provided to all
commercial areas. Parking lot access along Anton Boulevard will be limited to right -
in and right -out only. However, proposed and recently completed alternative access
points are anticipated to reduce impacts to less than significant levels; through a
proposed new access driveway aligned with Park Center Drive to serve the Westin
Hotel and a new right -in and right -out access along Bristol Street into Scotts
Restaurant. Construction will be phased to the extent possible. Loss of an existing
bus turnout is not considered significant since relocation of the bus turnout to the
south side of Scotts Restaurant's Bristol Street access will improve circulation.
Relocation of the turnout will provide a right turn bay for vehicles entering Scotts
Restaurant when not occupied by buses, and will increase the distance for buses to

merge safely into the northbound through lanes, prior to the Town Center Drive
intersection.
To the extent the mitigation measures do not mitigate the circulation and access
impacts, specific reasons support the decision for the project as contained in
Attachment W.
All significant environmental effects that can feasibly be avoided have been
eliminated or substantially lessened by virtue of mitigation measures identified in
the final EIR No. 1037 and Addendum No. 3 and incorporated into the project as
set forth above and in Attachment "C".
The project will cause a short-term increase in dust, as is typical of construction activity.
However, no significant temporary or long-term air quality impacts due to the project have
been identified. Future traffic levels will result in higher pollutant concentrations along
project roadways, which may result in the California standard for Carbon Monoxide being
exceeded. This is not, however, an impact resulting from the project; on the contrary, the
project is expected to reduce air pollutant concentrations by making traffic flow more
efficiently.
Findin
No significant air quality impacts have been identified.
Project construction will comply with applicable State and local construction
requirements to minimize dust and odor generation. The project serves to provide
regional air emission reductions, as it allows for more efficient traffic flow. As part
of the City's comprehensive traffic improvement program, which includes the
proposed project, the City will implement additional transportation measures which
may further improve local and regional air quality.

The project will result in temporary aesthetic impacts during construction, which are not
considered significant. Long-term significant aesthetic impacts may occur where
landscaping is removed due to right-of-way acquisition The revised project under
Alternative AB -1, Phase 1" will substantially reduce these impacts.
(a) Changes have been required in, or incorporated into, the project which avoid
or substantially lessen the impacts on the environment as identified in the
Final EIR No. 1037 to a level of insignificance.
As detailed in Attachment "C" and in the Final EIR No. 1037 (pages 194-195, and
Responses to Comments) and Addendum No. 3, impacts to Aesthetics will be
mitigated to less than significant levels. Street elements removed during construction
shall be replaced as appropriate in accordance with applicable standards. Replaced
street features include landscaping, trees, street furniture, bus shelters, and sidewalks.
To the extent the mitigation measures do not mitigate the aesthetic impacts, specific
reasons support the decision for the project as contained in Attachment "B".
All significant environmental effects that can feasibly be avoided have been
eliminated or substantially lessened by virtue of mitigation measures identified in the
Final EIR No. 1037 and Addendum No. 3 and incorporated into the project as set
forth above and in Attachment "C".
NOISE
The project will result in temporary noise impacts, although these are not considered
significant. No significant long-term noise impacts due to the project have been identified.
Existing and projected future traffic levels may expose residential areas to noise levels in
Attachment: "A"

excess of City standards; however, these impacts would be the same with or without the
project.
Finding
No significant temporary or long-term noise impacts of the project have been
identified.
In accordance with the City's adopted Arterial Highway Wall Master Plan, mitigation
for noise impacts due to cumulative traffic will be provided to qualifying existing
residential areas.
Proposed improvements may affect existing and future public service and utility facilities.
Project implementation will require extensive relocation of utilities and appurtenances. In
addition, construction activities could delay emergency vehicles and school buses.
Finding
(a) Changes have been required in, or incorporated into, the project which avoid
or substantially lessen the impacts on the environment as identified in the
Final EIR No. 1037 to a level of insignificance.
As detailed in Attachment "C" and in the Final EIR No. 1037 (pages 216-217, and
Responses to Comments) and Addendum No. 3, impacts to Public Services and
Utilities will be mitigated to less than significant levels. The City will, to the extent
feasible, maintain service during construction. Appropriate fire, police and school
agencies shall be notified prior to construction. Encroachment and improvement
design will require review and approval of the applicable agency.

State EIR Guidelines (Guidelines) promulgated pursuant to the California Environmental
Quality Act (CEQA) provide in part:
"(a) CEQA requires the decision -maker to balance the benefits of a
proposed project against its unavoidable environmental risks in determining
whether to approve the project. Where agencies have taken action resulting
in environmental damage without explaining the reasons which supported the
decision, courts have invalidated the action."
"(b) Where the decision of the public agency follows the occurrence of
significant effects which are identified in the Final EIR but not mitigated, the
agency must state in writing the reasons to support its action based on the
Final EIR and/or other information records. This statement may be
necessary if the agency also makes the finding under Section 15091(a) (2) or
(3)."
"(c) If an agency makes a statement of overriding considerations, the
statement should be included in the record of the project approval and should
be mentioned in the Notices of Determination." (Section 15094 of the
Guidelines)
On February 21, 1989, the City Council adopted the North Costa Mesa Specific Plan
Arterial Improvement Study, General Plan Amendment GP -89-1B. The City now proposes
to approve roadway improvement Alternative 'B-1, Phase 1" at the Bristol Street/Anton
Boulevard intersection. Because these actions together constitute a project under CEQA
and the Guidelines, a Program Environmental Impact Report No. 1037 (EIR) and
Addendum No. 3 were prepared by the City of Costa Mesa. The Finale EIR No. 1037 and
Addendum No. 3 have identified certain significant effects that will follow from this project
even after incorporation of all feasible mitigation measures. After determining that the
Final EIR and Addendum No. 3 are complete and has been prepared in accordance with
CEQA and the Guidelines, and making the Statement of Facts above, the City Council has
also weigbed the significant effects of the project against the overriding consideration noted
as follows:
1. The North Costa Mesa Specific Plan Arterial Improvement Study and Final
EIR and Addendum No. 3 provide the City of Costa Mesa with important
environmental and preliminary engineering design information for twenty -

four locations in the City. The General Plan Amendment would ensure that
all proposed improvements are consistent with the City's Master Plan of
Arterial Highways.
2. The project provides for adequate levels of service through the year 2010
through implementing roadway improvements at twenty-one locations in North
Costa Mesa. Two possible exceptions are Project Area Nos. .II and 19.
However, level of service forecasts do not account for traffic flow
improvements which may be achieved through bus turnouts and phasing,
which may lead to acceptable traffic flow. Adequate levels of service are
essential to the City's maintaining access for its residential, commercial and
industrial areas, in addition to maintaining an acceptable quality of life for
Costa Mesa residents. Adequate traffic flow is also essential to maintaining
a viable commercial and tourism industry.
3. The project provides for bus turnouts as recommended by the Orange County
Transit District, which serves to promote alternative transportation modes and
reduce regional vehicle emissions.
4. The project provides improved traffic flow along Harbor Boulevard, a key
element to the Orange County Transportation Commission's 'Superstreets"
program, designed to provide improved traffic flow along twenty-one major
arterials in Orange County.
S. Improved traffic flow will improve local and regional air quality and will help
to attain the objectives of the SCAQMD for the South Coast Air Basin.
The City Council finds and determines that the above economic, social and environmental
considerations outweigh the significant adverse environmental effects of the project.

IAnd use
# 1. Potential economic disruption to adjacent businesses shall be minimized by
maintenance of access to businesses, proper detours and directional signing to
businesses, as determined necessary by the City of Costa Mesa.
# 2. The City of Costa Mesa will need right-of-way from adjacent land uses to implement
the proposed roadway improvements, which shall be acquired as necessary.
Impacted properties shall be appraised, and the value of land and structures,
including severance and damages, shall be assessed. The criteria used in
determining appropriate mitigation measures for specific land use impacts shall be
on a unit cost basis (per square foot), with consideration to potential land use,
aesthetic and noise impacts. The City shall determine acquisition compensation on
a case-by-case basis, in cooperation with the affected parties. All compensation shall
be based on a property appraisal and fiscal assessment of other land use impacts.
Circulation and Access
Short -Term
1
# 3. Short-term mitigation to building access and to intersection use shall be mitigated
by a Traffic Control Program to be established by the City of Costa Mesa, This
program shall consist of prior notices, adequate sign -posting, detours, phased
construction and temporary driveways where necessary. Adequate access shall be
provided at all times to and from businesses. Proper detours and warming signs shall
be established to ensure public safety. Construction activities shall proceed in a
timely manner to reduce impacts to building access. The improvements of Project
Area No. 17 shall be constructed in conjunction with the Town Center Development
and administered by G. Segerstrom & Sons.
Long—Tern
# 4. The project itself may be considered mitigation for existing and anticipated future
traffic congestion. No further long-term mitigation is proposed.

Climate and Air Quality
Short -Tam
# S. Construction of the proposed project shall be required to be in compliance with
SCAQMD Rule 403, which shall reduce fugitive dust amounts by up to SO percent.
Dust reducing measures shall include regular watering of graded surfaces, restriction
of all construction vehicles and equipment to travel along established and regularly
watered roadways, and requiring operations that tend to create dust be suspended
during windy conditions. The project shall also comply with SCAQMD Rule 402,
to reduce potential nuisance impacts due to odors from construction activities.
# 6. In addition to stationary source and land use controls applicable to existing and
future projects utilizing project roadways, the following are applicable Transportation
Source Controls that have been identified in the City of Costa Mesa General Plan
(Environmental Resources/Management Element, page 23). The proposed project
shall incorporate these measures where applicable. It should be noted that the
project is, in itself, a mitigation measure for air quality impacts by improving traffic
now.
a. Establish a computerized, integrated traffic signal network for major
thoroughfares.
b. Prohibit on -street parking along major arterials to increase capacity and
improve flow.
C. Modify intersections (turn restrictions, ebannelization, etc.) to improve flow
and increase capacity.
d. Restrict truck traffic during peak hours.
e. Improve pedestrian safety along local streets and roads.
f. Reduce vehicular/bus conflicts by the construction of bus bays to remove
blues from traveled lanes.
Aesthetics
# 7. Although visual impacts will occur with implementation of the proposed arterial
improvements, most are short-term in nature and will not persist after completion
of construction -related activities (please refer to the Land Use section above for
additional mitigation measures related to aesthetics). Other more permanent
impacts shall be mitigated by the following measures (no significant impacts of these
measures have been identified):

a. Streetscape elements, including street lights, signs, and furniture shall be
relocated or replaced upon project completion.
b. Bus turnouts and shelters shall contain furniture in accordance with the
requirements of the Orange County Transit District's specifications.
C. New sidewalks and curbs shall be provided where existing sidewalk is
removed for roadway widening.
d. Landscaping removed by road widening shall be replaced onsite, where
feasible, by similar spectres in appropriate locations. Where replacement of
landscaping and trees is not possible in the immediate vicinity of the affected
area, replacement shall be provided in adjacent or "offsite" areas to enhance
other areas and offset project impacts.
e. Drougbt-tolerant plant materials shall be used for new landscaping material.
Noise
# B. Project construction and ongoing activities shall comply with the City Noise
Ordinance. Specifically, the project will be required to limit construction hours to
between 7:00 am. and 8:00 p.m. (no construction shall occur on recognized City
holidays).
# 9. Following preparation of final design plans and prior to project construction, a
detailed noise assessment shall be prepared to evaluate project and cumulative noise
impacts without structural mitigation measures, identity the degree of noise
protection from existing walls, and if necessary provide additional noise reduction
measures to comply with state and local noise standards. Additional measures may
include upgrading existing walls, prpviding new noise walls or providing double -
paned windows.
Public Services and Utilities
#10. Where intersection improvements shall impact utility and service lines and
appurtenances, the City of Costa Mesa shall modify the facilities or work with the
appropriate agency to accommodate intersection expansions. These modifications
include moving electric, gas, television, water and sewer lines. In addition, manholes,
meters, boxes, storm drains and fire hydrants shall be adjusted to street grade.
Several street lights and street signs within the project area must also be moved.
Facilities shall be relocated but will not be eliminated.

*411* The City shall coordinate with utility and service organizations to avoid disruption
of service as a result of project implementation.
#12. Underground Service Alert, an organization which alerts underground utility
companies of excavation near their facilities, shall be notified prior to intersection
improvement.
#13. All bus turnouts shall be designed in accordance with applicable City standards. and
Orange County Transit District design guidelines.
#14. Design plans shall be forwarded to the Mesa Consolidated Water District and
Metropolitan Water District. The City shall, to the extent possible, ensure that the
existing MWD O.C. feeder extension pipeline is not disrupted.
#15. The City of Costa Mesa Planning Department shall notify the local school district
and the City and County Police and Fire Departments at least one month prior to
improvements at any project area.
