A RESOLUTION OF THE CITY COUNCIL OF THE CITY 4 COSTA. MESA
APPROVING AN AGREE MT BY AND BETWEEN THE CITY OF COSTA MESA
AND C. J. SEGERSTROM AND SONS FOR THE DEVEIAPMENT OF MESA
VERDE DRIVE EAST AND GOLF COURSE DRIVE.
WHEREAS, there has been presented to the City Council of the City of
Costa Mesa that a certain agreement, attached hereto and by this reference
made a part hereof, for the development of Mesa Verde Drive East and Golf
Course Drive, by and between the City of Costa Mesa and C. J. Segerstrom and
Sons as agent for the owners; and
WHEREAS) this City Council deems it to be in the best interest of the
City that said agreement be ratified and approved;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa that said agreement, 8 8opy of which is attached hereto and by reference
made a part of this resolution, be and the same is hereby ratified and approved;
and
BE IT FURTHER RESOLVED that the Mayor and City Clerk of the City of
Costa Mesa are hereby authorized to execute said agreement on behalf of
the City.

above and foregoing Resolution No. 66-54 was duly and regularly passed and
adopted by the City Council of the City of Costa Mesa at a regular meeting
held on the 6th day of June, 1966.

AGREEMENT
THIS AGREEMENT made and entered into this_ day of
June, 1966, by and between the City of Costa Mesa, a Municipal
Corporation, hereinafter called "CITY" and C.J. Segerstrom and
Sons as agent for owners, hereinafter called "OWNER".
WITNESSETH THAT:
WHEREAS the Owners are possessed of certain real property
which the City desires to develop as streets within the City
of Costa Mesa being specifically Mesa Verde Drive East and Golf
Course Drive and
WHEREAS the City desires to have dedication of certain
real property by Owners in exchange for certain improvements
to be made by City,
NOW, THEREFORE, for and in consideration of the covenants
herein contained performed and to be performed the parties here-
to agree as follows:
(1) The owners have dedicated to the City of Costa Mesa
an eighty (80) foot right of way (recorded January 6, 1966,
Boo] 7800, Page 75) as appears on a map attached hereto and by
the specific reference made a part hereof, said right of way
to be for the improvement of Mesa Verde Drive East from Adams
Avenue to the intersection of Orange Avenue and the existing
Mesa Verde Drive East.
(2) The owners agree to dedicate to the City of Costa
%, Mesa a sixty (60) foot right of way for the improvement of
streets which shall be known as Golf Course Drive commencing
at a place on Mesa Verde Drive East and terminating at the north

line of the Municipal Golf Course now being developed by the
City, all as appears on Exhibit A attached hereto.
(3) in exchange for said dedication the City agrees
that it will stockpile all surplus dirt from its excavation
in an area immediately adjacent to these projects, the exact
location to be selected by Owner and that all surplus dirt
from its excavation shall become the sole property of Owner
for Owner's use and disposition.
(4) The City will provide through the Costa Mesa County
Water District for installation of water mains in accordance
with the requirements of the Water District at no cost to Owner,
said water mains to be constructed within the aforesaid street
right of ways. IT IS UNDERSTOOD AND AGREED that the City does
not waive its requirements for the payment of the water acreage
fee to be paid by any owner of the property at the time it is
developed, and it is further understood that no front footage
charges or assessments for any water mains installed in accord-
ance with this Agreement will be levied on any owner of the
property at the time it is developed.
(S) The City agrees to commence construction of the afore-
said streets on or before September 1st, 1966, and to pursue
said work diligently and in a workmanlike manner and to complete
the same on or before January 1st, 1967.
(6) Owner warrants said property to be dedicated is free
and clear of any and all encumbrances including any right of
ways which may conflict with said street dedication. Owner
FURTHER AGREES to execute the necessary easement or dedication
deed as shall be required by the City and to deposit the same

with the United States National Bank, 1845 Newport Avenue,
Costa Mesa, prior to August lst, 1966, and the parties hereto
agree that said easement deeds may remain in Escrow until such
time as the City has completed the work as set forth in this
contract.

hands on the day as first above written.
