A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, DIRECTING THAT THE CITY OF COSTA MESA MAKE A
CONTRIBUTION TOWARD THE WORK IN THE MERRIMAC WAY IMPROVEMENT
DISTRICT (ASSESSMENT DISTRICT NO. 17).
WHEREAS, the City Council of the City of Costa Mesa, California, did,
on the 2nd day of May, 1966, adopt its Resolution of Intention No. 66-38
for the grading, paving, and otherwise improving Merrimac Way and certain
other streets and easement as described in said Resolution of Intention No.
66-38; and
WHEREAS, it was the intention of the City of Costa Mesa that there be
included in said work of improvement aforesaid the installation of twenty-
two marbelite posts for light standards and four steel posts for light standards;
and
WHEREAS, in the proposal furnished to the bidders there was no paid item
for said above work, and no reference was made in the Notice Inviting Bids to
that certain agreement between the City and Southern California Edison Company
for the installation of said street light standards; and
WHEREAS, further, the City desires to make a contribution toward the said
work of improvement for the installation of said street lighting standards in
the sum of $7,557.95, plus 17% thereof to cover engineering and legal fees; and
it further desires to make a contribution of $17,500.00, plus 17% thereof for
engineering and legal expenses, for the installation of the traffic signal
system described in said Resolution of Intention No. 66-38; and
WHEREAS, the aforesaid contributions are desired to be made by City so
that the low bidder, to -wit: Sully Miller Contracting Co., will be paid said
sums without the levy of any assessment against the property owners for said
work described above;
NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby
resolve and determine as follows:
SECTION 1: Reference is made to that certain contract between the City
of Costa Mesa and the Southern California Edison Company referred to in Resolution
of Intention No. 66-38, and it is hereby resolved that on condition that the
low bidder, Sully -Miller Contracting Co., agrees to enter into a subcontract
with said Southern California Edison Company and to make the payment to said
Southern California Edison Company required by the aforesaid Agreement between
City and said Southern California Edison Co., City of Costa Mesa hereby agrees
to contribute the sum of $7,557.95, plus 17% for engineering and legal fees.
SECTION 2: City of Costa Mesa hereby agrees to contribute the sum of
$17,500.00 plus 17% for engineering and legal fees, for the installation of
the traffic signal system referred to in said Resolution of Intention No.
66-38 and as shown on the plans of said work, provided that the low bidder,
Sully -Miller Contracting Co., agrees to include the said work of the installa-
tion of said traffic signal system pursuant tD said Resolution of Intention No.
66-38 and the plans for said work.
SECTION 3: That the low bidder, Sully -Miller Contracting Co., will be
paid the aforesaid sums as above provided without the levy of any assessment
against the property owners for said work.

ACCEPTANCE
The undersigned, being the low bidder for the work of improvement in
Merrimac Way Improvement District (Assessment District No. 17), hereby
accepts the foregoing Resolution adopted by the City Council of the City
of Costa Mesa, California, and agrees to do the work in the manner and form
as provided in said Resolution.

above and foregoing Resolution No. 66-66 was duly and regularly passed and
adopted by the City Council of the City of Costa Mesa at a special meeting
held on the 25th day of July, 1966, by the following roll call vote:
